Tax Advantages

Along with Act 20, Puerto Rico adopted the “Act to Promote the Relocation of Individual Investors” (Act 22) to stimulate economic development by offering nonresident individuals 100% tax exemptions on all interest, all dividends, and all long-term capital gains to entice nonresidents  to relocate in Puerto Rico.

Eligibility

Under the P.R. Internal Revenue Code: Nonresident individuals who become residents of Puerto Rico are considered eligible under Act 22 unless the individual was a resident of Puerto Rico at any time beginning on January 16, 1997 and ending on January 16, 2012.  An individual that becomes domiciled in Puerto Rico is considered a Puerto Rican resident. An individual’s 183-day physical presence in Puerto Rico establishes a presumption of residency under the Puerto Rico Tax Code.

Under the U.S. Internal Revenue Code: Under U.S. IRC §933,income derived from sources within Puerto Rico by individuals qualified as bona fide residents are exempt from federal income taxation. For an individual to considered a bona fide resident of Puerto Rico under U.S. IRC §937, an individual must be present in Puerto Rico for at least 183 days of the year. Second, the individual must not have a tax home outside of Puerto Rico during the year. A tax home is determined to be located near an individual’s principle place of business. Third, the individual must have a closer connection to Puerto Rico than the U.S. or another country. This is determined by a variety of factors including but not limited to the location of individual’s home, family, personal belongings, and voting district. The tax exemption period begins on the date an individual becomes a resident of Puerto Rico.

Tax Incentives

0% Taxes on Dividends and Interest: A qualified individual’s income from dividends and interest are exempt from Puerto Rico income taxes during the exemption period. A qualified individual is also exempt from U.S. federal income taxes if the revenue generated is considered Puerto Rico source income under U.S. IRC §933.

0%-10% Taxes on Capital Gains: A qualified individual’s income from long-term capitals gains is exempt from Puerto Rico income taxes during the tax exemption period after the individual becomes a resident of Puerto Rico. A qualified individual’s long-term capital gains prior to becoming a resident of Puerto Rico are subject to a 10% tax rate if realized within 10 years of residency or 5% if realized after 10 years of residency.

Under U.S. law, long-term capital gains prior to becoming a bona fide resident of Puerto Rico that are realized within 10 years are subject to the provisions of U.S. IRC. If the long-term capital gains are realized after 10 years, the U.S. tax rate is 0%. Thus a bona fide resident would only be subject to the 5% Puerto Rico tax rate.

Puerto Rico approved the “Law to Promote the Exportation of Services” (Act 20) in order to establish Puerto Rico as an international service center. Puerto Rico seeks to allure outside service entities via tax incentives to relocate to the island for the purposes of stimulating economic growth and social improvement.

Act 20 applies to any entity with a bona fide establishment in Puerto Rico that is engaged in an eligible service for export. Eligible services include but are not limited to: investment banking and other financial services, research and development, advertising and public relations, consulting, electronic programming development, call centers, professional services, and centralized management services. An eligible service must also qualify as an export service. An eligible service done by a foreign entity or non-resident individual that does not relate to business activities within Puerto Rico qualifies as an export service. An eligible service provider is required to obtain a Tax Exemption Decree that will endure for a term of 20 years and may be renewed for an additional 10 years. The Tax Exemption Decree constitutes a contract between the service provider and the Puerto Rican Government that is immune to any future legislation.

These lucrative tax incentives apply to all new Puerto Rican businesses under a Tax Exemption Decree:

• 0% Taxes on Earnings and Profit: The exemption includes a 100% tax exemption of earning and profit distributions on income generated from export services.
• 3-4% Flat Income Tax: A 4% flat income tax rate on income generated from export services, or a 3% tax when more than 90% of an service provider’s gross income is from export services.
• 0% Property Tax: 100% property tax exemption for the initial 5 years of operation for certain export services including corporate headquarters, call centers, shared service centers for accounting, finance, marketing, human resources, and other centralized management services. After the 5-year period expires, a 90% tax exemption will apply for the remainder of the Tax Exemption Decree.

This marina does not require a credit card to hold the slip or any type of deposit. As a courtesy please notify the marina if you need to cancel your reservation at least 24 hours in advance.

A SECURITY DEPOSIT EQUAL TO ONE MONTHS DOCKAGE WILL BE PAID WITH FIRST MONTHS DOCKAGE. THIS SECURITY PAYMENT IS APPLIED TO THE LAST MONTHS DOCKAGE WITH 30 DAYS NOTIFICATION OF DEPARTURE. FAILURE TO PROVIDE 30 DAY NOTICE FOREFEITS DEPOSIT

Customers that own two boats are eligible for a 20% discount on the published dockage rate for the smaller of the two boats. Boat’s belonging to an immediate family member of long-term customers can receive a 10% discount (See office for details). Both accounts must be current at all times to receive discounts.

All monthly Dockage is due by the 10th of the month. A $25 late fee applies for any outstanding balance past the 10th of the month. Customers on the promotional rate not paid in full by the 20th of the month will be placed on the Monthly Dockage Rate. Customers can elect to have a Credit Card on file for automatic payment on the first of the month.

The Yacht Club at Palmas del Mar: Puerto Rico’s and Caribbean’s First Resort Mega Yacht Marina Opens

The Yacht Club at Palmas del Mar, another multi-million dollar investment at Palmas del Mar, inaugurated the first mega yacht resort marina in Puerto Rico and in the Caribbean today.

The 162 slip luxury marina can accommodate mega yachts up to 200 feet long and provide them with resort hospitality and amenities no other marina in Puerto Rico can provide. The Yacht Club will offers its members a restaurant, bar and grill, private members lounge, pool, convenience store and deli, a marina and resort wear shop as well as concierge services for its guests. The wet slips are already open to guests and the Club facilities and fuel dock are projected to be completed by January 2009.

“The Yacht Club at Palmas del Mar opens Puerto Rico to a new kind of tourism that will generate new opportunities and jobs,” said Luis F. Muñiz, President of PDMYC INC., developers and owners of The Yacht Club. “It also requires that we develop new skills, talents and amenities in a type of tourism that has gone largely untapped but that can generate many new economic opportunities.”

“The Yacht Club at Palmas del Mar is another strategic project for Palmas del Mar Properties that contributes to position Palmas del Mar in a new luxury category that is in line with the new hotel investments like Mandarin Oriental, that recently was announced”, said Jaime Morgan Stubbe, ESQ., President of Palmas del Mar Properties Inc., master developer of Palmas del Mar and partner of this project.

“These novel installations will surely attract a new marine product to the Island, and a high class market, that will have a multiplying effect on the different economic sectors of the country” stated Terestella González Denton, Executive Director of the Puerto Rico Tourism Company. “The construction of these facilities in our Eastern-Central Region is another one of our goal that became a reality: turning Puerto Rico into the main port of Entrance for Mega Yachts in the Caribbean, one of the fastest growing markets within the maritime sector at the level of the Americas”, pointed González Denton.

The construction of the marina created 250 jobs and its operation will generate 150 jobs. The Yacht Club will be managed by Marina Management Services, Inc. (MMS), a renowned international management and consulting firm based in Boca Ratón, Florida. MMS has operated marinas for over 20 years and continues to be one of the highest ranked marina facilities in the Caribbean Basin. Tim Keogh, Director of Business Services – Regional Manager, will be in charge of jumpstarting the operation.

Keogh has been recognized by the Boating Industry Magazine as one of the “Top 40 under 40” leaders in the marine industry. “It’s an exciting opportunity to open up the southeast coast of Puerto Rico to the cruising, charter, and transient yacht market,” said Keogh. “We look forward to delivering similar levels of customer service that have distinguished ourselves, members and guests of The Yacht Club at Palmas del Mar.”

The Yacht Club was developed by PDMYC INC. a company with experience in the construction and development field.

Palmas Del Mar Properties Inc. is the owner and master plan developer of Palmas del Mar. In 2002 the Puerto Rico Homebuilders Association recognized Palmas as the best master planned resort community in Puerto Rico and last year presented it with the Heritage Award for its environmental initiatives.
