Toby Hodges takes a look at all the nominees and the winner of the best luxury yacht category in the European Yacht of the Year Awards

The definition of the best luxury yacht will differ according to personal opinion and from boat to boat. This year’s nominees in the luxury yacht category of the European Yacht of the Year Awards proved that perfectly.

The European Yacht of the Year awards are selected by a broad panel of expert judges from across the globe. These are people who spend their professional lives sailing and comparing yachts, so you can be certain that the yachts which stand out in this field are truly the best of the best on the market.

The best luxury yachts

Best luxury yacht winner 2024 – arcona 50.

When you enter the fiercely competitive 50ft luxury performance yacht market you better get it right. And the jury felt Arcona managed that. This watershed design for the traditional Swedish brand, by X-Yachts co-founder and former designer Niels Jeppesen, is a big, contemporary new Arcona, one that sees it move away from its cruiser-racer heritage and classic interiors.

The on trend styling inside and out is backed up by a premium level of build and finish quality and sailing performance – particularly if you have the performance sails, traveller and deep (2.95m) keel options the test boat carried, although the latter does limit your berthing and anchoring options.

While I doubt it’ll be raced or will suit typical bluewater use, it offers a purity of performance push-button sailing: a handsome prospect upwind in a light breeze, it transforms into a powerful reaching machine with stacks of control.

As chairman of our jury, Jochen Rieker, puts it: “The boat certainly did not win for her somewhat borrowed looks. She wins by checking all the boxes in all other respects. Slipping along gracefully in the lightest of airs, holding her stride and her balance in more demanding conditions, offering warmth, light and this reassuring feeling of utter quality down below – there simply isn’t anything to fault.”

Contest 50CS

The Contest 50CS, for example, is an archetype luxury cruising yacht, one built to the highest standards and that could take you to most waters in impeccable comfort. This model is, uniquely, available in two versions: this more conventional 50CS with aft master cabin, or the forward owner’s suite version on the aft cockpit Contest 49CS . We ran a full test on the latter after spending two days aboard in the North Sea, where that noticeably high freeboard, which may not aid boarding nor windage, helped keep us dry on deck in a steady Force 6 gusting 7.

As the 50CS proved, this Judel/Vrolijk design keeps slipping along in the light stuff too, providing enjoyable sailing in 6 knots breeze under a code sail. The centre cockpit offers a deep protected guest area, but also links well to the spacious aft deck.

And the Wetzels-Brown-designed interiors of Contests today are stunning and hard to match. The engineering, access to usable stowage, details and finish on the 50CS is first class and to get this level of quality at this size is special.

Both Contest and X-Yachts are early adopters of hybrid power, offering their bluewater cruisers with optional electric drives. For the XC 47 this was designed-in from the start to offer Oceanvolt’s award-winning new 25kW regenerative drive.

The XC 47 is another wonderfully engineered and thought out yacht for distance cruising, in particular for those who also enjoy hands-on helming pleasure. That should come as no surprise to any X aficionados, but what really struck me most about this yacht was the stowage, and the forethought needed to create that, together with how practical it has been made.

That may sound slightly anticlimactic but ask any long-term cruiser and stowage is always a priority. On deck, this constitutes a huge lazarette and sail locker, plus clever systems for launching a dinghy via davits and a liferaft canister, while below decks every square inch of space has been used effectively, with lockers hinged with gas struts.

It’s clear the Danish yard went to considerable time and effort, even building a full mock up of the interior that could be canted 20° each way.

If the deck saloon style looks didn’t sell this model to all – this is the first full non-Jeppesen designed X – the jury were converted once they’d taken the helm. ‘Quirky’ became ‘muscular and bold’. The ease with which it can be sailed from the cockpit was also appreciated.

While I understand many offshore cruisers like a protected centre cockpit and more sun protection, the attention to detail, stowage and practicalities, combined with the direct steering, motion and enjoyable sailing this X offers make it a standout new offering.

Jeanneau Yachts 55

Meanwhile the Jeanneau Yachts 55 stands out for different, unique reasons in this category, offering a completely new concept in comfort on deck while at anchor and a novel accommodation layout. Its focus is on outdoor living space.

What helps place this in a luxury bracket is not simply the price or the creative input of superyacht specialist design duo Philppe Briand and Andrew Winch, rather that its layout creates a palatial amount of private space for the owner’s suite. Guest cabins have their own direct access from the extensive cockpit via gullwing doors.

It certainly makes sense for solo owners or couples using it as a warm water apartment. How many people this will suit is another question, as it segregates any guests, crew or children from the galley and saloon.

I used the term monocat when I first viewed it, as the 55 really does attempt to mix the two worlds, particularly in terms of providing owner privacy and lounging space. Choose the rigid hard top and windshield and there’s a vast amount of covered area including a dinette and chart table – plus a bimini can shade all that extensive aft deck too.

The penalty comes in additional weight and wetted surface, and is felt in the handling and performance, the latter particularly in lighter breeze with the optional in-mast furling, self tacking headsail and shallow draught package we had. However, it’s set up to be easily managed from the mid cockpit with good visibility from the twin helms and easy circulation thanks to the ramped side decks. Full report in YW February 2024.

Best luxury yacht 2023

Best luxury yacht winner – oyster 495.

It is hard to imagine that the decor of a yacht can change its look and feel quite this much, yet the layout of this second 495, Eddie Jordan’s dramatic looking Tuga , is in fact identical to the first boat that I spent several days aboard last summer.

At its heart is a wonderfully (Humphreys) designed and engineered luxury bluewater cruiser conceived from the ground up, built in a new dedicated facility to a repeatable quality very few yards are capable of.

The 495 offers consistent passage making speeds in real voluminous comfort – whether enjoyed from the deep cockpit or the best-in-class aft cabin. Deck stowage and mechanical space is also superb.

Then factor in the family appeal of Oyster’s after sales and world rally programme and you start to appreciate the premium world this sub 50-footer gives access to.

The first yacht fully conceived under CEO Richard Hadida’s reign, this is also the smallest completely new Oyster 495 since 2005 – and it’s a triumph. It was our September 2022 cover star in which we featured the full review from our Oyster 495 three day test .

Beneteau Oceanis Yacht 60

The Oceanis Yacht 60 is a very different beast indeed to the 62 it replaces as flagship for the Beneteau range. The yard has learned plenty from the success of the First 53/OY 54 and wanted to create a 60 in this style and with the same deck layout (albeit larger and wider) and ease of circulation.

The construction experience of the smaller model clearly helped too, as this is a whopping five tonnes lighter than the bulky OY62 and with a deeper (2.6m) keel. The telling result is on the water. It feels sporty to helm and we averaged a knot slower than the single figure 6-8 knot windspeeds upwind and matched them reaching with Code 0 and a slight swell.

The vast cockpit works well, sheltered below the semi rigid bimini, it has plentiful lounging space with sailing systems led aft to the twin helms. The interior sees a 3+3 layout, where Beneteau wanted to get rid of the corridor effect of the OY62. The galley is forward to help open out space, while the forward suite with offset berth and headboard aft works well to give space with privacy.

This is an attractive, voluminous yacht that leaves a good overall impression whether under sail, on or below decks.

Ice 62 Targa

It all looks pretty funky below decks on the Ice 62 Targa too, especially if you’re watching the masthead fore and aft cameras (plus bow and prop cam) on central displays mounted in the saloon while you slip out of the dock! The Ice is a seriously impressive, contemporary yacht, one that in looks, performance and execution, won over many of the judges.

The first to launch is a highly customised project for a passionate sailing owner who covers long distances solo – he’d already sailed it 3,000 miles around the Med that autumn. It’s impressively stiff, sails handsomely and, thanks to a telescopic keel, points well. We matched single figure windspeeds, and clocked up to the high 9s in 12 knots wind.

Umberto Felci’s team spent 4,000 hours on the design, providing lots of space and light to the interior and a chillout zone in the semi raised saloon. This was easily the coolest looking yacht, with its aggressive reverse bow, chamfered gunwales and carbon T-top bimini, and all engineered and built to a high standard.

What is gratuity for a day charter?

The customary crew gratuity is between 15 – 20% of the charter fee depending on the location of the charter.

Am I permitted to use the yacht’s watersports toys on a day or 1/2 day charter?

Yes, you can use them during your charter. However, availability may vary depending on the yacht, so it’s advisable to check with the charter company beforehand.

What is included in the rate of a daily cruise?

Fuels for the itinerary of your choice, VAT of 24%, experienced crew, snacks & sandwiches, fresh fruit platter, cold cuts, chips & nuts, local wine, beers, beverages & bottled water, beach towels, snorkeling gear, Wi – Fi, Safety equipment, Port Fees & Taxes.

Not included are:

  • Crew gratuity – 15% of the charter fee.
  • Shore excursions

What is the maximum capacity for a daily cruise?

The maximum capacity for a daily cruise depends on the protocol of each yacht. Generally, the maximum capacity of the Greek Day Charter fleet is 20 guests. For larger groups, we can arrange a combo of yachts, allowing for more guests to enjoy the experience together. Combo yachts offer the opportunity for groups to have fun and cruise in tandem.

Are pets allowed on board?

It depends on the yacht and owner’s policies. Some yachts may allow pets, while others may not. If you wish to bring a pet, kindly inform us, and we’ll check with the yacht owner to see if it’s possible.

Can I bring my own alcohol and food onto the boat for a day charter?

You are allowed to bring their own alcohol and food onto the yacht and we can also arrange to have beverages delivered to your boat prior to embarkation or to have a chef onboard.

Is smoking allowed on board the yacht?

Smoking is not permitted inside the yachts for safety reasons, although it is allowed in the open deck areas as designated by the captain.

What is the minimum length of a day charter?

The minimum length of charter is a half-day cruise that lasts 4-5 hours.

Of course, more extended charter options are available as well, depending on the preferences and needs of the guests.

How Far in Advance Should I Book my Yacht Charter Vacation

Depending on the time of the year you wish to vacation it is important to book at least six to nine months in advance.

Do I need Travel Protection?

We recommend that you protect your vacation investment against various possible losses over which you have no control by purchasing travel protection. We will provide travel protection quotes based on the households on the charter and each person’s date of birth. It is necessary to send us this information.

Please Note: To be eligible for the waiver of pre-existing medical condition exclusion, the protection plan must be purchased within 15 days (Travel Basic) or 21 days (Travel Select) from when you make your initial trip deposit. However, the plan can be purchased anytime before departure.

What is the APA (Advance Provisioning Allowance)?

An Advance Provisioning Allowance is a pre-paid expense for the operating cost of the yacht while on your charter.  It is usually between 20 – 35% of the weekly charter rate, depending on the type of boat. It is pre-paid in addition to the weekly charter rate and VAT to cover the cost of the following:

  • Fuel for the main engines, generators, tenders, motorized water toys, b. For food and drinks for your charter,
  • Port fees, harbor fees, marina dues,
  • Customs clearance,
  • Personal laundry,
  • Communications.
  • Consumables for the charter party.
  • Any shore excursions and transfers arranged by the yacht for the guests.

During your charter, you can view the APA expenses with the captain. When your cruise ends, the captain will determine if you owe money or are due a refund. Some APA statements are more detailed than others. Reviewing the details and requesting receipts if there are questions is essential.

What type of clothing should I pack?

Unsurprisingly, one of the FAQs for luxury yacht charters is what to pack. Your cruising area will largely determine the type of clothing you want to bring due to the various climates. For instance, cruising through New England, you may need a sweater or windbreaker as the evening can be crisp. If you’re traveling through the Caribbean, the temperature can be warm year-round, but ladies might especially appreciate a wrap or shawl, as the evening breeze can be fantastic.

Regardless of your cruising area, resort casual is usually the comfortable attire unless you have planned a formal evening with the crew or on-shore dining.

Operating for more than 100 years, they offer the Full Custom and Limited Editions, ranging from 108 to 272 foot LOA. The facilities are used for both military and commercial vessels, and they employ the most skilled workers in the industry.

Their most noteworthy launches in the last couple of years are the 243-foot Universe, the 205-foot Sea & US, along the 189-foot Volpini 2. The potential owners are able to customize both interiors and exteriors according to their taste.

One of the oldest and largest superyacht builders in the world, Benetti has been making custom and semi custom builds since 1875. They currently have 97 yachts under build larger than 78 feet. Founded in 1978, this Dutch superyacht brand specializes in custom-made builds. Therefore, their fleet is limited, so there are three different ways to own a Heesen boat. Through the Pure Custom program the buyer can order a unique individual design and engineering.

The Platform Concept program offers custom exterior design but standard engineering, and the third option is to buy a brand new custom superyacht as soon as it is made available for purchase. Oceanco Project-Bravo

A fairly young company, this Dutch company based in Alblasserdam has been around since 1987. They specialize in custom expedition yachts ranging from 262 to 459 feet. The builder launched Project Bravo in 2018, which is a fuel efficient and eco-friendly innovative design. Their green technologies are predominant in their newest addition to their fleet.

Lürssen is a family business who believes in producing the best quality yachts in the world. Focused on excellence, this German company is another leader in the luxury yachting world. Their eight shipyards located in the northern part of the country have been responsible for building more than 13.000 vessels since 1875.

Lurssen Azzam Superyacht

Four new renders reveals a closer look at State of Craft's cruising concept.

As the rest of the world advances toward the skies and beyond , the prestigious design studio State of Craft is looking to the waters. The leading studio – which has previously worked on some of the world’s most outstanding residential developments, including The Shard Residence in London – presents the Mako , a cruising concept that the brand described as the bold future of explorer yachts .

The Mako is the brand’s first dip into the waters of nautical design , but what an ambitious debut. The almost 395-ft superyacht is an adventurous take on cruising explorers, featuring long-range ice cruising capabilities and a zero-carbon footprint – all with a design inspired by the shark that gives its name. 

After making its public debut in 2022 , the subsequent noise showed the market’s hunger for a sustainable and luxurious cruising vessel. Building on that excitement, State of Craft has released four new renders of the yacht’s generous interiors.

Giving a closer look at what is to come for the concept, the new images reveal the Mako’s observatory, studio and master suite. 

The brand has also revealed to Elite Traveler that, while it is difficult to put a cost on the project, it is estimated the superyacht would cost “between €250m and €500m” (approx. between $268m and $536m).

The images give a better look at the Mako’ s unconventional structure, which uniquely blends the hull and superstructure into a seamless overall form, creating a continuation of surface that allows for seamless transitions from the yacht’s interior to outdoor decks. 

At the heart of the yacht is the studio, a light-filled, double-height space with uninterrupted views to both the foredeck and aft deck. This generous and comfortable space flows to the outdoor spaces of the yacht’s aft deck, which wraps around the vessel’s hall.

Towards the hull, the unique arrow shape forms a large platform, which has been dubbed the vessel’s beach club for its use for sports and other activities. This central section of the deck can be retracted and the door lifted to allow tender boats to drive directly into the hull and moor internally.  

Above the top deck is the pavilion, a versatile space that can be used as a yoga studio, fitness space, panoramic lounge or even a night sky observatory.

Meanwhile at the bow, the wide and long foredeck has integrated a generous landing platform that has been designed specifically for a VTOL personal Lilium jet, which State of Craft says offers significantly increased safety compared to a helicopter.

And it’s not just in its design where the Mako seeks to break conventions. With its propulsion system of hydrogen tanks, fuel cells and electric engines – combined with a battery storage system and solar panels – the Mako is set to be a sustainable evolution of the luxury superyacht.

Benetti's M/Y Triumph out at sea

When it comes to luxury yachts, Benetti is the leader in the industry. It attracts the very wealthy titans of industry, be they financiers, tech innovators, sports superstars or music and fashion icons, and even fictional action heroes. Think James Bond. Think Beyonce and Jay Z on the Mediterranean, who have chartered Benetti’s mega yacht the Lana replete with helipad, pool, gym, cinema room - a mansion on the high seas. Think footballer Zlatan Ibrahimovic who treated himself to a 34-meter Benetti Oasis 34M model.

Benetti has an incredible nautical history. It continues to be a leader and innovator in the yachting sector 150 years after it was founded in Viareggio, Italy. A new book from Assouline entitled Benetti celebrates the sailing history of the company, filled with lavish photographs that would make even those who are new to the boating world drool and fantasize about owning a mega yacht.

Below Benetti/Azimut’s chair Giovanna Vitelli shares some insights on the company, catering to the super rich and the future of luxury yachts.

How does the yacht client differ in terms of wants and needs from region to region?

The customization of a Benetti yacht is based on the lifestyle of each individual owner. It reflects the owner’s personality, dreams, and needs, even though there are cultural requests that vary from region to region. For instance, for US owners, a frequent request is a large bar paired with barbecue on the upper deck. Some clients might request extensive wine cellars, while others need a full-on office space to get work done while onboard. A spa, a larger space to store water toys, a gym area, and so on…

Who is the Benetti client? What do they expect from a yacht?

A Benetti client is elegant and sophisticated, most typically a man typically in his fifties. Owners are now trending typically 10 years younger than before. Of course, we are still talking about very wealthy and successful people, but unlike the past, where yacht ownership may have primarily symbolized opulence, today's owner seeks something deeper - a private space for special moments to share with family and friends. A floating home, with all the personal comforts, to enjoy a closer connection with the sea.

How do you anticipate the rapid advancements in technology given that it takes years to complete a yacht?

By investing. We started investing in technology more than 20 years ago when my father created an internal R&D department aiming to reduce fuel consumption. Since then, the guiding principles of the Group's product philosophy have been innovative exterior and interior design for the creation of a new onboard lifestyle, while reducing CO2 emissions and energy consumption, both of which are consistently reflected in our yachts.

An example of technology applied to design is our innovative OASIS DECK®: two highly engineered lateral wings that can open while at anchor to enlarge the outside area in the stern, creating a "beach area" on the water. This revolutionary system was designed in collaboration with the UK-based RWD studios before COVID, and anticipated the need that arose during the pandemic to connect with nature. The enlarged stern also features an infinity pool seamlessly integrated into the flush deck. We have created a new, informal lifestyle onboard with this transformative design – and the OASIS DECK® has been a big success in terms of sales.

Where do you see the yachting industry heading?

There is a noticeable trend in our industry: a younger clientele compared to just five years ago, with a more conscious approach. Sustainability should no longer be merely a marketing pitch within the industry, and we, as leaders, feel the need to drive this change. Yacht owners are increasingly embracing the concept of mega yachts constructed using durable, sustainable materials, and energy-efficient technologies, resulting in reduced carbon emissions.

The next objective is to further optimize consumption and emissions generated by onboard systems. This subject is especially relevant to larger boats, which spend around 90% of their time at anchor. Benetti has begun to address this by developing the “Zero Emission Hotel Mode” powered by fuel cells and advanced power management systems, including solutions to reduce air conditioning energy consumption by up to 50%.

Additionally, for our use in tests, sea trials, etc, we have turned to HVOlution (Hydrogenated Vegetable Oil), produced by ENI, a biofuel made entirely from renewable raw materials. Our recent tests recorded a reduction in well-to-wake CO2 emissions from 60 to 80%, compared to a yacht of comparable size powered by fossil fuel.

What have been the most out-of-this-world request you’ve ever had for the outfitting of a boat?

We have added things like a wood-burning pizza oven and a flower refrigerator. We’ve done a copy of the Sistine Chapel fresco over the dining table on a Benetti yacht.

How do you marry the tradition and history of Benetti with the increasingly modern world of today?

At Benetti, our goal is to blend our rich heritage with the utmost in design and engineering. Take, for instance, our models like the Motopanfilo 37M, which pay homage to maritime history while adding a touch of modern flair. The traditional 1960s aesthetics are reimagined for a modern lifestyle by renowned talents such as Lazzarini & Pickering. Our collaborations extend beyond the nautical realm to include designers and architects from diverse backgrounds, like Bonetti/Kozerski, whose expertise in luxury brands (such as Donna Karan and Tod's), hospitality, and the new Pace Gallery in New York has been seamlessly applied to Benetti’s OASIS line.

An ultra-luxury cruise line wants to attract wealthy Americans with its all-inclusive 'yachts' — see what the new 128-guest ship will be like

  • Ultra-luxury cruise line  Emerald Cruises says its third ocean ship will debut in 2026.
  • The all-inclusive vessel, which Emerald calls a "yacht," would accommodate up to 128 people.
  • Emerald, known for river cruises, has been investing more in its ocean-based business.

Over the last few years, the mass-market cruise industry's larger-than-life mega-ships — outfitted with loud waterparks and more dining options than you could eat in a week — have dominated the spotlight.

But in the ultra-luxury cruise market, it's been the opposite. The smaller and more exclusive the vessel, the better. So much so that Emerald Cruises' next ocean-based ship, launching in 2026, plans to accommodate no more than 128 travelers.

It's a far cry from Royal Caribbean's new 7,600-guest cruise liner . And the price difference is just as steep: almost $250 per night on Royal Caribbean's Icon of the Seas versus more than $720 per night on the upcoming ultra-luxury Emerald Kaia.

"When people think of cruising now, they automatically think of these large ships ," Robert Castro, the vice president of marketing for Scenic Group, Emerald's parent company, told Business Insider. "There's a market for that, but we're in a unique position."

If you’re familiar with river cruises, Emerald might ring a bell.

The cruise line, owned by Scenic Group, only offered river cruises for its first nine years.

But lately, its biggest growth and investments have been in oceans, not rivers.

In 2022 and 2023, the Switzerland-based company launched its first two ocean cruise ships, which it calls "yachts." Each accommodates a maximum of 100 guests . And so far, they've been hits, with the cruise line experiencing record-high bookings in 2023.

Yes, the ships look like yachts. And yes, they're marketed as such.

But because Emerald's vessels operate group itineraries, they still technically count as cruise ships, albeit really nice ones.

So instead of paying hundreds of thousands of dollars a week to charter a yacht, as is traditional with these high-end vessels , travelers can spend less than $800 a day for a traditional cruise on said yacht-like ship.

While it's not nearly as exclusive, it sure is a hell of a lot cheaper, "bringing the charter yacht experience to reach for people who would never even imagine," Castro said.

Emerald’s upcoming 393-foot-long, 128-guest Kaia would be perfect for fans of small, high-end ships.

The 64-cabin Emerald Kaia would have a larger guest capacity than its two predecessors but would still be tiny compared to most cruise ships, including some of the most luxurious ones.

Regent Seven Seas' new Grandeur can accommodate 746 guests, while Ritz-Carlton says its next ship will sail up to 448 travelers.

Even Four Season's upcoming vessel — with fares up to $350,000 a week — would have a larger guest capacity of up to 222 people. However, it would be almost 290 feet longer than Emerald Kaia.

Like traditional cruise ships, Kaia would have amenities like a spa, two lounges, and three dining options.

The top deck would also have a cabana and bar-lined pool, one of three swimming holes on the ship.

But unlike its mass-market competitors, Kaia would have an open-air marina that would give travelers direct access to the water.

Water platforms are typically only common on yacht-marketed ships, such as Emerald's, Ritz-Carlton's, and, someday, Four Seasons'.

This means guests on the upcoming Kaia could dip in the Mediterranean, Adriatic, and Aegean seas — as is included in its 2026 and 2027 itineraries — without disembarking the ship.

According to the cruise line, Emerald Kaia's future itineraries include an 11-day sailing from Cyprus to Greece and a 20-day one from Seychelles to Kenya.

Its cheapest itinerary is currently an eight-day roundtrip Seychelles vacation in 2027, starting at $5,055 per person.

As an all-inclusive cruise line, amenities like alcohol, WiFi, and excursions would be included in the base fare. However, unlike all-inclusive competitor Regent Seven Seas , guests must pay for their flights to and from the ship.

To compare, itineraries of the same length on Regent's Seven Seas Grandeur and Ritz-Carlton's Ilma would be $36 cheaper and $120 more expensive, respectively, per day.

But the fares aren't stopping travelers from gravitating toward Emerald. Before it unveiled Kaia, its parent company announced a record number of bookings in January — up 67% compared to its previous record in January 2020.

Castro said about 20% to 35% of its guests are American, typically well-acquainted with luxury travel.

The company's goal has been to increase its number of American customers. So far, it's working and is now "on track to be Emerald's No. 1 market," Castro told BI.

The new vessel is being built at a great time for the cruise line.

Strong demand, compounded by a small fleet of small ships, has led to fewer available cabins for its upcoming summer Mediterranean cruises.

Several of these sailings are now fully reserved. The cheapest remaining fares start at $4,570 per person for an eight-day November sailing from Athens, Greece, to Dubrovnik, Croatia.

It's great news for Emerald as it considers a future with more ocean "yachts." "The sooner we fill the ships, the sooner we start building new ones," Castro said.

Fine increased to $1.8M for yacht grounding at Honolua; includes cultural resource damages and community distress

The Board of Land and Natural Resources increased a fine against the owners and operator of the luxury yacht, Nakoa, to $1,818,85.97 on Friday, to account for biological and cultural damages, as well as “emotional distress to the community.”

The luxury yacht grounded on a reef approximately 600 yards north of the Honolua-Mokulē‘ia Bay Marine Life Conservation District in February 2023.  It was scuttled in 800 feet of water on March 5, 2023, after it was freed from the rocky shoreline near Honolua  where it had been grounded for nearly two weeks.

After hearing impassioned testimony from members of the community, the tentative proposed fine of more than $117,000 for damage caused to corals and live rock, was increased.

“A slap on the wrist in this situation, would be a slap in the face of this community,” said John Carty of the Save Honolua Coalition.

BLNR Chair Dawn Chang said, “We commend members of the community, especially those from Honolua, who came forward to share their concerns.  We heard you, about the cultural significance of the place and these resources and we really appreciated their participation in this process.”

The original lesser fine was recommended by the DLNR Division of Aquatic Resources (DAR), while leaving consideration of penalties for biological and cultural damage, and community distress, to the board.

In DAR’s submittal to the BLNR, it stated, “The DLNR does not have a tool to obtain a monetary value for emotional distress and cultural damage to the public, but DAR acknowledges the volumes of public testimony received at the July 2023 and January 2024 BLNR meetings, and at a February 2024 Maui community meeting regarding its emotional distress and loss of use. Therefore, the DLNR leaves the decision to levy additional appropriate fines against the responsible parties to the board in its discretion.”

This was the third time an enforcement action against Jim Jones, Noelani Yacht Charters, LLC and Kevin S. Albert, Kimberly L. Albert, and the Albert Revocable Trust, had come before the BLNR.

In July of last year, the Alberts and their trust reached a tentative agreement with the board to pay a settlement in the amount of $117,471.97. The BLNR reserved its right to assess fines and penalties against Jim Jones and Noelani Yacht Charters. After six months and despite numerous requests to the Alberts, the settlement did not materialize.

In January, the DLNR renewed its administrative enforcement action against all parties. The board’s final action was deferred, and it directed DAR to hold a community meeting in West Maui to receive input on the final civil fine amount. That meeting, on February 22, in West Maui at Kumulani Chapel helped staff solicit input from community members affected by the grounding incident.

According to the submittal for Friday’s BLNR meeting, DAR indicated three general themes emerged from the community meeting.

  • The recommended fine amount was too low; the Board should pursue the maximum fine to deter this type of behavior in the future;
  • Any fines paid by the Responsible Parties to the DLNR should be used for the increased enforcement of existing rules and/or for better, more durable moorings; and
  • If the DLNR cannot adequately police and manage Honolua Bay, then Honolua Bay should be closed to all commercial activities.

Chang said: “This was a win for natural, biological, and cultural resources and for an entire community which places great value on a cherished bay and the life it supports. I’m proud of the BLNR for sending a strong message, that if you damage Hawai‘i’s precious resources and cause distress for people, the penalties can be significant.”
