Sally has valuable experience having worked for Virgin Atlantic Cabin Crew. Sally joined the Aqua Marine team in 2021 and assists in providing organisational support to Board as well as heading up the HR department. Daiva joined Aqua Marine in 2021 as an Accounts Administrator. She now works primarily in payroll across our crew management division. Daiva is studying towards ACCA and has a background in the Regulated Financial industry.

The team at Aqua Marine are thrilled to be the lead project team for Project 406. This will be the largest and most luxurious true sports fisher in the world. We are delighted to be working with Royal Huisman, Vripack, Bush Noble and Hampshire Marine on this ground-breaking project. 

Aqua Marine also undertook the registration of a Jersey based company to allow a yacht the flexibility of travelling around the world trip under a red ensign. This is very exciting as it will allow the client to have no surprises and continual enjoyment of their vessel around the globe. This Yacht is due to be first of its class and revealed at the 2021 Southampton Boat Show.

Two newly filed federal lawsuits claim that 10% sales commissions required by South Florida’s yacht broker industry are anticompetitive and violate antitrust laws.

The claims follow an October finding by a federal jury in Kansas City, Missouri, that the National Association of Realtors conspired with brokers to artificially inflate commissions paid to real estate brokers. The ruling, and a March 15 settlement by the Realtors, is expected to radically change how homes are sold in the United States.

Both lawsuits involving yacht brokers name as defendants the International Yacht Brokers Association, based in Fort Lauderdale, the Yacht Brokers Association of America, Boats Group LLC and YATCO LLC.

Also listed as defendants in both suits are a who’s who of South Florida-based yacht brokers, including Denison Yacht Sales, MarineMax Inc., Galati Yacht Sales Inc., Allied Marine Inc., Tournament Yacht Sales LLC and Northrop & Johnson Yacht Ships, among others.

Nearly all of the defendants are headquartered in South Florida.

The most recent suit, filed on March 22, proposes a class of plaintiffs that includes anyone who listed vessels on certain Multiple Listing Services using a listing agent or broker affiliated with one of the defendants and paid a buyer’s broker commission since March 22, 2020.

The lead plaintiff in the lawsuit is Kip Lamar Snell, identified as an Alabama resident. Snell entered into an agreement with Galati to sell a 41-foot Express Cruiser Sea Ray in July 2020 and ended up paying a $12,000 commission on the $120,000 sale price, the suit states. The lawsuit lists as defendants 15 brokers and six organizations that promote the yacht trade or operate Multiple Listing Services.

That lawsuit follows one filed on Feb. 29 that proposes a class of plaintiffs that includes anyone who paid a commission to a listing broker affiliated with the defendants since Feb. 19, 2020. It lists as defendants 11 brokers and five organizations that promote the yacht trade or operate Multiple Listing Services.

The lead plaintiff in that suit is Ya Mon Expeditions, a Wyoming company that paid a “substantial broker commission” when it sold a vessel in January 2023 while represented by Tournament Yacht Sales of Tequesta.

The most recent complaint accuses the trade associations of colluding with brokers to “enforce an anticompetitive restraint that requires (sellers of pre-owned yachts and boats) to pay a brokerage fee to the buyer’s broker and a total aggregate commission fee that is inflated as a condition for selling their yachts.”

The complaint states the typical commission is 10% and is shared between the seller’s broker and the buyer’s broker under terms spelled out in Central Listing Agreements provided by the brokers associations, including the International Yacht Brokers Association and the Yacht Brokers Association of America.

Only boat brokers are able to list boats and yachts on such Multiple Listing Services as YachtWorld.com, BoatTrader.com and Boats.com, and the Multiple Listing Services will not accept listings from owners who want to sell their vessels themselves, the lawsuit states.

Yacht owners are “severely disadvantaged” if they do not list their boats for sale on the listing services, while buyers suffer because their brokers are “financially incentivized” to show boats that will earn them standard “and inflated” commission rates of 4% to 5% through co-brokerage transactions, the complaint states.

None of the defendants contacted for this story responded to a request for comment, and no response has been filed yet in either case.

Robert Allen Jr., whose Miami-based law firm Robert Allen Law represents the International Yacht Brokers Association, did not respond to emails or return a phone call.

A woman who answered the phone at the International Yacht Brokers Association said, “We have no comment on that,” and hung up after a reporter asked for her name.

Of six brokers contacted for comment about the lawsuits, only Tournament Yacht Sales responded to emails. “No comment,” the company’s response stated.

Overall commissions have increased faster than the rate of inflation in recent years as the price of larger boats and yachts have increased, according to the lawsuit that lists Snell as lead plaintiff.

The result is that boat owners pay “hundreds of millions of dollars” in inflated commissions each year, the suit alleges.

Both lawsuits allege violations of the Sherman Antitrust Act that are upheld by “brokers who should be competing with one another but, instead, cooperate with each other to the detriment of pre-owned boat sellers.”

Some brokerages represent both buyers and sellers and retain the entire 10% commissions, the suits state.

The trade associations enforce rules requiring brokers to offer their boats through a listing service and to share commissions, the suits state, adding that they can impose significant penalties on members who do not comply with their rules.

Yacht purchasers are disadvantaged by the current system, the lawsuit alleges, because their agents would otherwise negotiate for their business by decreasing their commission rates.

But buyer brokers’ commissions have remained constant despite their diminishing role, the suits state. Many buyers today find boats they are interested in purchasing through online searches and enlist the services of a buyer’s broker only after identifying the yacht they want to buy, the suits claim.

The lawsuits seek an order declaring the commission structure to be illegal, a permanent injunction outlawing what they describe as anticompetitive conduct, plus damages and/or restitution, pre- and post-judgment interest, and attorneys’ fees.

Paul Geller, an attorney for one of two law firms representing the class that includes Snell, acknowledged “parallels between the allegations relating to commissions in the real estate and yacht markets.”

In the real estate matter, the National Association of Realtors on March 15 agreed to a $418 million proposed settlement that would free home sellers from paying commissions to brokers for both sellers and buyers.

After a jury ruled for the plaintiffs in the case against the National Association of Realtors in October, numerous lawsuits were filed across the country with similar allegations, including one in December against the Florida Association of Realtors and 16 brokerages.

“At bottom, the goals of (the suit against the yacht brokers) are similar: protecting consumers by challenging what we allege to be anti-competitive conduct,” Geller said by email. “We believe in the universal truth that consumers benefit by increased transparency and the competitive pricing that results from negotiated terms, including commissions.”

Geller is a partner at Robbins Geller Rudman & Dowd LLP, which specializes in securities litigation on behalf of investors. The firm has offices in 10 cities, including Boca Raton.

“We are thrilled to collaborate once again with Red Yacht Design on the creation of the Aluna 92,” FDC Yachts director Eyup Ozbelen said in a statement. “Together, we aim to deliver a yacht that not only exceeds expectations but also redefines the very essence of luxury on the water.”

FDC says the Aluna 92 will be the first yacht in its class capable of accommodating helicopters. The vessel features a large touch-and-go helipad on the aft deck that can welcome large choppers capable of carrying up to four passengers, meaning that it can facilitate far more elevated comings and goings than its competitors. The aft deck is also equipped with a large lounge and an alfresco dining area for open-air soirees.

Other exterior highlights include a sprawling sundeck adorned with sunbeds and an expandable beach club with direct ocean access. FDC has also opted to include see-through bulwarks on some exterior decks to provide seafarers with panoramic ocean views.

The interior is equally as spacious and luxurious. The generous cabins can sleep up to eight guests, with the lavish full-beam owner’s suite transforming into separate cabins if additional accommodations are required. Such flexibility renders the Aluna 92 suitable for charter.

“We are confident that the Aluna 92 will exceed the expectations of even the most discerning yachtsmen,” added managing partner of Red Yacht Design Faith Surekli.

FDC says construction on the first Aluna 92 is scheduled to commence by the end of this summer.

NEW YORK – New York City Mayor Eric Adams today announced “ Jobs NYC ,” a new multi-pronged citywide effort to reduce barriers to economic opportunities and deliver workforce development services directly to communities across the five boroughs that are experiencing high unemployment. The collaborative effort will focus on three core pillars: 1) revamping the administration’s “hiring halls” in an effort to bring public and private job opportunities and career services to economically-disadvantaged communities on a monthly basis in each borough, 2) launching a new Jobs.nyc.gov talent portal to connect New Yorkers to job and training opportunities, and 3) continuing to reform the city’s Minimum Qualification Requirements to make certain entry-level jobs within city government are more accessible. In June 2023, Mayor Adams removed the bachelor’s degree requirement for certain city jobs.

“While we have a lot to celebrate in recovering all of the private-sector jobs lost during the pandemic — more than a year ahead of schedule — our recovery has not been equitable and it has not yet reached every New Yorker. That’s why we are doing everything we can to make sure New York City remains a city for working-class people,” said Mayor Adams . “Black unemployment is still far too high in New York City and across the nation, but Jobs NYC will bring a whole-of-government effort to meet New Yorkers where they are — helping to build an economy of the future with real pathways to family-sustaining careers. This is how we ensure all New Yorkers, particularly those in Black and Brown communities, have access to the jobs of the 21st century, and this is how we can continue to recruit a workforce that is reflective of the diversity of our city. Jobs NYC will help us build a city where opportunity reaches every borough, block, and neighborhood.”

“We have recovered all of the private-sector jobs lost during the COVID-19 pandemic. However, that recovery has not been equitable,” said  First Deputy Mayor Sheena Wright . “The unemployment rate for Black New Yorkers is 9.3 percent compared to 3 percent for white New Yorkers. This difference is unacceptable. Through a new jobs portal, hiring halls across the five boroughs, and changes to the Minimum Qualification Requirements for city jobs, we are making additional changes to close that gap. These investments build upon the Adams administration’s work throughout the past two years. We created job hubs in select neighborhoods, launched the largest public-private loan fund for small businesses in the city’s history, and set a $6 billion record in M/WBE awards. Today’s announcement ensures that all New Yorkers have the opportunity to participate in the city’s thriving economy.”

“At the start of this administration, we committed, through Executive Order 22, to invest in the city’s talent and workforce development systems,” said Deputy Mayor of Housing, Economic Development, and Workforce Development Maria Torres Springer . “The key to that investment was to develop strategies that centralize, and better coordinate workforce services and programming for the benefit of New Yorkers who need them most. The Jobs NYC portal and Jobs NYC hiring halls — digital and physical points of entry to the city’s workforce system — bring public and private employment opportunities and workforce programming together in a central place, realizing the goal of a better centralized and coordinated talent and workforce development system that meets New Yorkers where they are.”

“Jobs NYC provides the full spectrum of resources a New Yorker needs to find a job, from a one-stop shop online portal to career training to job opportunities in both the private and public sectors, and delivers it right to the communities most in need,” said  Deputy Mayor for Strategic Initiatives Ana J. Almanzar . “This all hands-on-deck government approach will make it easier for New Yorkers to better participate in our economy and uplift entire communities. I want to thank all the community based-organizations, government agency partners, private-sector collaborators, and my fellow deputy mayors who are ensuring that everyone has a fair chance to prosper in our economic recovery.”

As a result, we continue to see more New Yorkers relying on government benefits to make ends meet,” said  New York City Department of Social Services Commissioner Molly Wasow Park . “With Jobs NYC, the Adams administration is taking the necessary steps to reverse this trend and ensure that New York City’s recovery is truly equitable. We look forward to working with our Jobs NYC partners to reduce barriers to employment and connect disadvantaged New Yorkers to quality employment opportunities that will lead to long-term financial security.”

Through Jobs NYC, this city is helping bridge the gap — bringing employers to the table and placing job opportunities at the fingertips of every New Yorker,” said  New York City Chief Equity Officer and Mayor's Office of Equity & Racial Justice Commissioner Sideya Sherman . “The city is taking an important step in reversing this trend by focusing resources, including hiring halls, trainings, and educational programs, towards the communities with the highest unemployment rates. Chaired by First Deputy Mayor Wright, with Deputy Mayors Torres-Springer, Almanzar, and Williams-Isom as co-chairs, Jobs NYC brings a whole-of-government approach to building a more equitable city through workforce development. Working across nearly two dozen city agencies, in addition to partnering with community organizations and private partners, the Adams administration will revamp the already popular hiring halls. Not only will these hiring hall take place in each borough on a monthly basis in areas of the city experiencing employment disparities, but — in addition to connecting New Yorkers with job opportunities in the municipal workforce — these events will now provide jobseekers with the unique opportunity to engage with multiple organizations, including employers interviewing for roles and community-based organizations connecting talent to training and other opportunities.  

To deliver job and training opportunities citywide, the Adams administration also launched the Jobs NYC online talent portal, a free resource managed by the Mayor’s Office of Talent and Workforce Development and accessible through the MyCity portal that connects job seekers to career opportunities, free employment services, and occupational-skills trainings for opportunities in both the public and private sectors.

In June 2023, DCAS began reducing barriers to employment within city government by reforming the city’s Minimum Qualification Requirements for entry level civil service titles. To date, DCAS has completed review on 17 entry-level titles with the potential to impact 20,000 jobs and expand eligibility for civil service positions that were previously restrictive and posed difficult for many applicants to meet minimum qualifications. Previous requirements mandated a college degree or credits, but with this updated review, the city is now more inclusive and equitable, focusing on relevant work experience and practical skills rather than formal education.

Today’s announcement builds on a series of policy reforms made by Mayor Adams to retain top talent in the city workforce, provide high-quality services to New Yorkers, and create equitable pipelines to enter the city’s workforce, which has historically been a vehicle for economic mobility for millions of New Yorkers. Last month, Mayor Adams made city government more family-friendly for thousands of employees by expanding both paid parental and family leave for non-union city workers. Impacting over 10,000 municipal employees and making the city more competitive with municipalities and employers across the country, the Adams administration doubled paid parental leave for non-union employees, from six to 12 weeks, and began providing up to 12 weeks of paid family leave for those caring for seriously ill family members.

In the last 13 months, Mayor Adams has successfully negotiated contracts with unions representing 95 percent of the city’s workforce and 100 percent of the city’s uniformed workforce — the quickest any mayoral administration has reached that milestone in modern city history. These agreements with District Council 37 , Communications Workers of America Local 1180 , the Marine Engineers’ Beneficial Association , Uniformed Sanitation Workers’ Union Local 831 , the United Federation of Teachers (UFT), the Police Benevolent Association , the Uniformed Officers Coalition , the Council of School Supervisors and Administrators , Teamsters Local 237 , and dozens of other unions have all included wage increases, including retroactive wage increases for employees that had not received a raise in years. Additionally, many of these contracts included dedicated funding to address retention and recruitment challenges and other important benefits, such as the child care fund established in the agreement with DC 37.

Additionally, in an effort to retain talent in the human services sector, just two weeks ago, Mayor Adams announced a $741 million investment for an estimated 80,000 human services workers employed by non-profit organizations with a city contract as part of a new cost-of-living adjustment.

“The nonprofit sector is an economic engine in New York, and human services organizations help people find jobs and also employee over 125,000 workers in New York City, said Michelle Jackson, executive director, Human Services Council . “Unfortunately, the sector is facing significant vacancy rates and the recent multi-year -of-living adjustment investment announced by the mayor goes a long way in helping that, but we also need to find and retain new talent. Jobs NYC provides a great opportunity for local nonprofits to find that new talent while also connecting people in their programs to other job opportunities, particularly in areas with high unemployment.”

“Economic opportunity is critical for safe, healthy communities,” said Ionna Jimenez, project director, Brownsville Community Justice Center . “By bringing employment opportunities right to Brownsville's doorstep, Jobs NYC's localized approach not only reduces barriers to employment but also promotes greater community cohesion and fosters economic growth at the grassroots level.”

The Jobs NYC effort builds on the commitment of the Adams administration to the development of an inclusive, post-pandemic economy by increasing access to employment-related resources and on-ramps online and in-person,” said  Gregory J. Morris, chief executive officer, New York City Employment and Training Coalition .   “As a membership that is relied to connect New Yorkers, of all ages, in every borough, to people on the path to good paying jobs that sustain them and their communities, we acknowledge the innovative initiatives put forth by Mayor Adams to make New York 'work' for working people. From the moonshot goal on apprenticeships and the establishment of an Office of Community Hiring to the Women Forward NYC Action Plan and today's announcement regarding the reformation of the city's minimum qualification requirements, we are readying New Yorkers who drive our local economy today, and our young people who will make up our future workforce for this transformative moment in our city’s economic development and growth.”

The application of ASC 606 is not a simple exercise – it requires significant judgment, estimation and disclosures. Changes in business practices and the economic environment continue to create new challenges to the accounting for revenue.

In response to these challenges, companies evaluate and may need to revisit a number of estimates and judgments to account for their revenue arrangements and related costs. Companies may also apply certain aspects of the guidance that they had not, or less frequently, applied in the past.

In this publication, we focus on the accounting and disclosure aspects of ASC 606. In what is no surprise, Warner Bros Motion Picture Group is getting into business with its Dune and Wonka star Timothée Chalamet, and has hammered a multi-year first look feature film deal with the Oscar nominee as actor and producer.

Between the Dune movies and Wonka, Chalamet’s recent pics with the Burbank, CA lot have delivered $1.6 billion to studio coffers. Chalamet became the first actor in over four decades to star in the top two domestic-grossing films released in an 8-month period.

He also is a 3x Golden Globe nominee for Wonka (Best Actor, Comedy/Musical), Call Me by Your Name (Best Actor, Drama) and Beautiful Boy (Supporting Actor). Among the filmmakers Chalamet has worked with in addition to Guadagnino and Nolan are Greta Gerwig, Denis Villeneuve, Adam McKay and Wes Anderson. He has starred in five Best Picture Oscar nominees:  Call Me by Your Name, Lady Bird, Little Women, Dune  and  Don’t Look Up .

Chalamet previously served as a producer on Guadagnino’s Bones and All  which was produced independently and sold to MGM. He’s currently filming James Mangold’s  A Complete Unknown  for Searchlight, in which he stars as Bob Dylan and also serves as a producer.
