OFFER PROCEDURES

Offers are accumulated weekly through each Monday at 4:00 PM ET. In the event a particular Monday is a Federal Holiday, the deadline is extended an additional 24 hours. The high offer on a particular vessel is submitted to the Seller for consideration the following business day. The Seller, at its sole option, may accept or reject with or without a counter offer. Responses typically occur within 48 hours, no response constitutes a rejection of theoffer.

Upon notification of acceptance of an offer (either verbal or electronic), successful Bidder has 1 business day to deposit into National Liquidators escrow account, the greater of 10% of Gross Offer or $1,000.

Upon notification of acceptance of an offer (either verbal or electronic), successful Bidder has 5 business days to complete any and all conditions listed above in the “Conditions Of Offer”. In any case, any remaining amounts due must be deposited into National Liquidators escrow account, within 5 business days after notification of acceptance of an offer (either verbal or electronic). Successful Bidder’s failure to fund the total offer price within 5 business days after notice of acceptance will result in forfeiture of any deposits. In these instances, the vessel will be placed back into the auction cycle.

After funding the total offer price, Successful Bidder must remove the purchased vessel from National’s storage facility within two business days or make storage arrangements with National. Storage charges will accrue on ALL purchased vessels until each is removed from National’s storage facility. Standard storage rates apply; refer to http://www.yachtauctions.com/services for currentrates.

All vessels are sold AS IS, WHERE IS, with no warranties or representations, express or implied, as to condition or fitness for a particular purpose.

NOTICE REGARDING TITLING OR US COAST GUARD DOCUMENTATION

National Liquidators makes no guarantees, representations or warranties as to title or the ability to document or register the vessel. National Liquidators are acting as a broker only and issues as to title, documentation and registration are between the Buyer and the Seller, owner or lien holder. The required $399.00 administrative fee covers National’s efforts to obtain titling and documentation information from the Seller; it does not include transfer of title or documentation to Buyer. National Liquidators can process transfer of title or documentation to Buyer an additional fee. Buyers that are interested in this service can contact National’s title department for details, including charges. Ohio Law requires National to transfer title (not USCG documentation) directly to Ohio residents only, a $150 fee is charged for this service.

IMPORTANT INFORMATION REGARDING SALES TAX

Purchasers must pay sales tax at the applicable rate in their respective states. Dealers that wish to be treated as tax-exempt are required to provide a state sale tax number, valid marine dealer’s certificate, sign a Resale Certificate or Statement for Exemption of Purchase, and any other required documentation.

METHODS OF PAYMENT

All payments required herein must be in certified funds or bank check drawn on a US bank, wire transfer or cash. Personal checks or credit cards are not acceptable.

What becomes of a sanctioned Russian billionaire’s superyacht after it’s seized ? In the case of the $75 million Axioma , the end result was an auction for way below its market value.

The lavish 236-footer, which was seized from Russian steel magnate Dmitry Pumpyansky in March, attracted 63 bids at a sale in Gibraltar. A true watershed moment, it is the first public auction of an oligarch’s asset since Russian forces invaded Ukraine in February.

The superyacht, which boasts six luxurious guest cabins, an infinity pool, a spa and a 3-D cinema, was detained by the Gibraltar government after a legal claim from JP Morgan said Pumpyansky’s holding company Pyrene Investments owed the bank more than $20 million.

The Office of the Admiralty Marshal in Gibraltar confirmed on Tuesday that 63 bids were received for Axioma , but refused to reveal the value of the bids, as reported by the Guardian .

“The successful bidder will be selected by the Admiralty Marshal but details of the bidder and the value of the offer will remain confidential,” the court said in a statement. “Details about the sale value of the vessel will be made available once the transaction has been completed which could take place in approximately 10 to 14 days.”

James Jaffa, a lawyer for British firm Jaffa & Co, told the Guardian that he expects Axioma to sell for “way below” $20 million.

The west has confiscated billions worth of assets since March. British and American authorities have previously said they would seek to funnel the proceeds of sold assets back into Ukraine. This auction has attracted controversy, though, because Axioma has been sold not for the benefit of the Ukrainian people, but for the US investment bank.

Still, the has set a “benchmark” for other banks looking to recoup losses by auctioning assets.

“ Axioma will be a watershed moment for assets that have bank financing against them because all the other banks will realize that the asset can be sold and that they can get some or all of their money back,” Jaffa adds.

Brokers’ responsibilities remain unchanged. Literally. Brokers continue to address questions, perform showings, attend sea trials, and manage the closing and financial transactions. Here's how online yacht auctions work for sellers

Sellers and listing brokers decide on the date they want the yacht sold. Boathouse Auctions provides owners the opportunity to sell quickly, yielding the highest possible net return in typically about four weeks.

Sellers set the reserve price and capitalize on the finite timeline and urgency of auctions. 3. Vessel Surveys

7. Buyer's Premium

The US wants to auction off an oligarch's seized $300 million yacht that's been racking up $600,000 a month in maintenance

  • The US wants to auction a $300 million superyacht seized from a Russian oligarch due to high maintenance costs.
  • The yacht, allegedly owned by sanctioned billionaire Suleiman Kerimov, was seized in Fiji and then moved to the US.
  • Another Russian oligarch, Eduard Khudainatov, claims to own the yacht and wants it back.

The US wants to sell a $300 million superyacht seized from a Russian oligarch because it's getting too expensive to maintain it, a court filing from Friday shows.

The yacht in question is the 348-foot-long Amadea , which was seized in Fiji in April 2022. The yacht has a helicopter pad, a swimming pool, fire pits, and a movie theater.

Amadea was then seized by the US Department of Justice. It arrived in the country in June. US officials allege the ship is owned by sanctioned Russian billionaire Suleiman Kerimov , who is worth $9.2 billion.

Since seizing the ship, the US government has been paying $600,000 a month in maintenance — a cost that is "excessive," according to the court filing, which Business Insider viewed. The US is now requesting a judge's permission to auction off the superyacht.

"The carrying costs for the Amadea are far from modest, and there is good cause to spare the Government and the public from bearing these costs," the filing states.

The problem is that another Russian oligarch, Eduard Khudainatov, claims to own the yacht and wants the vessel back. Khudainatov hasn't been sanctioned by the US.

Legal representatives for Khudainatov did not immediately respond to Business Insider's request for comment sent outside regular business hours. They told Bloomberg in a statement that the seizure was "unlawful" and that their client would pay the US back for the maintenance of the Amadea yacht.

The legal wrangling surrounding the Amadea underscores the challenges of determining the ownership of a superyacht due to a complex ownership structure that could include shell companies.

This could prolong the process of determining the next steps surrounding the yachts — which are sitting around and racking up millions of dollars in annual maintenance fees borne by taxpayers.

The case is US v. M/Y Amadea, 23-cv-09304, US District Court, Southern District of New York.

DeLand cancer survivor goes for Guinness World Record in boating challenge

Scott Flowers loves a good challenge. Even when the odds are slim to none, backing down is never an option.

Doctors first found the growth in a routine checkup in 2015. Flowers, 63, had no real symptoms but was told the pinkish-colored mole on his back was cancerous and the disease had spread to his lungs.

The five-year survival rate for Stage 4 melanoma is 15 to 20%, according to the American Cancer Society .

"And I just said, 'Game on,'" said Flowers, a DeLand resident.

Now, nearly 10 years later, he is cancer free.

It is with that same sense of confidence that Flowers embarks upon his next trial. A licensed charter boat captain, Flowers ― who also goes by "Captain Red" due to his ginger hair ― will set out June 15 on a journey called the Great Loop , traveling some 6,000 miles of contiguous waterways along the eastern seaboard, the Great Lakes and eventually the Mississippi River, looping back around to Key West.

Here's the thing, though: He's aiming to make the voyage in just over a month where most boaters take several months or even years to complete the feat. As such, Flowers is hoping to set a record with Guinness World Records.

His goal is also to raise $1 million through a combination of private donations and corporate sponsorships to benefit the National Pediatric Cancer Foundation .

'Straw that broke the camel's back'

Flowers gives credit to his wife, Tammy, for making sure he keeps up-to-date with dermatology appointments. This boat captain has spent years in the sun and with his ruddy Irish skin knows he can't take any chances. His mother died of cancer; so did a brother and sister. All three had been diagnosed in their 50s.

After the discovery of the skin tumor, Flowers immediately began treatment at UF Health Shands in Gainesville. Sometimes he'd go in for just a day to do a port infusion, other times there were longer stays, for more involved procedures.

Across the floor from his unit at the facility was the children's cancer ward and Flowers and his wife got to see some of the same faces ― kids, parents, medical personnel ― coming and going.

If he was fighting his own cancer battle in middle age, he could only imagine how that same battle would feel for younger people and their families.

One year, around Christmas, the Flowers stopped seeing one pediatric patient show up to appointments.

"That was the straw that broke the camel's back," Flowers said. "It set me on fire. I said, 'Tammy, I need to do something.'"

As far as his own health, Flowers learned about a drug still in the trial stages about halfway through his treatment. Keytruda was approved by the U.S. Food and Drug Administration in 2023.

So the captain rolled the dice again.

"It was my only choice," he said.

Months into the experimental treatment, the cancer riddling his body began to diminish, and then nearly shrank away. The disease got better, but then worse, setting up an emotional roller-coaster.

He battled back again and now has been free of cancer for almost four years.

But Captain "Red" Scott Flowers never forgot his vow to give back.

Enter the Great Loop

He'd heard about the Great Loop from a boating friend who'd completed it, joining a legion of so-called "Loopers."

"So being as competitive as I am, I started looking around to see what was the fastest time anyone had done it in, and I wanted to try to do it in about a month," Flowers said.

He'd originally set out to take on the expedition around 2020 working with the National Pediatric Cancer Foundation to publicize it, but COVID put that plan on hold.

"He is amazing," Chris Geib, chief development officer with the NPCF told The News-Journal. "He's so passionate about it, and he just kept coming back and pushing it [the challenge]."

The boat he will captain is a 28-foot vessel custom built for both shallow water and offshore navigation. It has been donated to Flowers specifically for his journey through a partnership with Florida boat manufacturer Canyon Bay .

Said Canyon Bay chief executive officer Ross Toepel, "What really drove us to [doing this] was Red's passion and his inspirational story."

Moving the needle

Joining him on the challenge will be three friends: retired 7th circuit judge James Clayton; retired DeLand businessman Scott Schwerdfeger, and DeLand-based veterinarian Michael Bailey.

They're aiming to log at least 16 hours on the water each day and, as Flowers said, "We'll spend the night wherever we can."

If that "wherever" happens to be on the boat, it will be on the top deck with only bean-bag cushions in the way of comfort.

The challenge is substantial.

"Most people do the Great Loop as a leisure trip; they'll take four or five months and cruise very slowly," Geib said.

The fundraising goal is substantial as well, according to Geib, saying, "That [amount] will go pretty far."

And that makes it all worth it for Flowers.

"We are going to make a difference," he said. "We are going to move the needle."

Kicking off with the fundraising campaign, a banquet and auction was held last weekend at the Lake Beresford Yacht Club in DeLand. Once anchoring ashore after the Great Loop, the boat will go up for auction with the proceeds benefiting the NPCF and go toward meeting the total fundraising goal.

The National Pediatric Cancer Foundation plans to track the boaters and provide updates on their progress in real time on social media.

All the highlights from the Superyacht Charities Ball 2024

This year’s Superyacht Charities Ball was another resounding success, raising £90,000 for charity. An astounding £850,000 has been raised in six years. 

This year’s event on 16 March, partnered by BOAT International, saw more than 500 of yachting's power players get behind some truly worthy causes: Team Endeavour Racing which provides powerboat racing for wounded, injured and recovering service personnel and veterans; Oceans For Hope, a charity which introduces people with, or impacted by MS to sailing; Oarsome Chance, helping disadvantaged young people in the Portsmouth, Gosport and Havant areas and SYC’s grassroot charity Cash 4 Causes, which aims to help the growth of smaller non-government funded not-for-profit organisations. Headline sponsors for the night were Döhle Yachts, Lürssen , LA Marine, ISC, Peninsula, Oyster , Refit International and Starboard.  Fendequip sponsored the event programme. 

The night got off with a flying start with pre-dinner drinks and a brief welcome from the Chairperson, followed by a three-course banquet and live auction sponsored by Njord by Bergman Design House, with prizes including a VIP experience to see Ronan Keating at Kew Gardens and hospitality tickets at Newbury Races. The after-dinner raffle sponsored by Cecil Wright saw one lucky recipient win a skippered day onboard for four people with Flexisail Boat Club.

Guests danced until the early hours at the Mary’s Stadium in Southampton. A fancy-dress photo booth with bubbles proved to be quite the star attraction with party goers. 

Founded in 2015, Superyacht Charities continues to grow year on year. The charity hosts up to six events per year for charitable causes including the annual Cricket Challenge, the Seafarers Supper in Palma and an Antigua Sundowners soiree for the Antigua Yacht Show. The Superyacht Charities Ball has become a firm fixture on the annual yachting calendar.
