A guide to the International Safety Management (ISM) Code and why yachts need it

The International Safety Management (ISM) Code is a set of international guidelines which all commercially registered yachts over 500 gross tonnes must adhere to. It was set by the International Maritime Organization (IMO) to ensure safety at sea, prevent human injury or loss of life and avoid damage to the marine environment.

Why was the ISM Code established in the first place?

The ISM code was established following a series of serious shipping accidents in the 1980s, which resulted in loss of lives, damage to the ships and pollution to the environment. The cause of these accidents was a combination of human error on board and management failings on shore. The maritime industry needed a big change to prevent those type of accidents being a regular occurrence.

What does the ISM Code mean for Yacht Owners and operators? 

The ISM Code requires owners and operators of ships to implement a Safety Management System (SMS) to ensure compliance with rules and regulations related to the objectives of the Code and the effective implementation and enforcement thereof by Flag State Administrations. Each company’s SMS should include:

  • A safety and environmental protection policy
  • Instructions and procedures to ensure safe operation of ships and protection of the environment
  • Defined levels of authority and lines of communication
  • Procedures for reporting accidents and non-conformities (which are ‘identifiable deviations that pose a serious threat to the safety of the personnel/ship or a serious risk to the environment and require immediate corrective action’).
  • Procedures to prepare for and respond to emergency situations
  • Procedures for internal audits and management reviews.

Who needs a Safety Management System (SMS)?

As we mentioned above, all commercially registered yachts over 500 gross tonnes must adhere to the full ISM Code. Commercial vessels under 500 gross tonnes but over 24 meters should adhere to what’s known as ‘mini-ISM’ – a safety management system that complies with the requirements of their Flag State.

Setting up an effective Safety Management System can be a rather difficult task, which is why using an experienced professional management company is of paramount importance. Divergent Yachting’s SMS is approved by the relevant Flag States under which the yachts operate, which then issue a Document of Compliance (DOC) authorising Divergent Yachting to operate the ISM system.

Although SMS is not obligatory for private yachts under 500 gross tonnes, we have been finding that more and more private yachts choose voluntary compliance to improve overall safety onboard and environmental standards.

At Divergent Yachting our primary goal is not to ‘manage’ the captain and crew – we know they are already competent – but rather ‘support’ them in the best way possible with a safe and efficient running of their superyacht.

We understand that every client has different requirements, hence we offer ‘Full Support’ or ‘Modular Support’ services to ensure compliance with the ISM Code:

  • An appointed Designated Person Ashore (DPA) who serves as a link between the company and onboard personnel and has direct access to the highest level of management. The DPA monitors all safety and pollution-prevention aspects of the ship operation and ensures that adequate resources and onshore support are applied.
  • 24/7 Emergency Response and Shore based ‘Emergency Response Team’ (ERT)
  • Allocated Yacht Manager to deal with all ISM related duties
  • Arranging all Class, Flag and Radio Surveys
  • Attending yachts prior to Audit/Survey to carry out Pre-Audit/Survey check
  • Attending all Class and Flag Surveys
  • Liaising with yachts to ‘close out’ any Non-Conformities/Observations
  • Liaising with Flag, Class and other regulatory agencies on behalf of the yacht
  • Ensure all ISM/ISPS/MLC certificates & all yacht certificates remain in date – Flag, Class and other Certs with expiry/renewal
  • Attest that all potential crew for hire are correctly certified for position onboard
  • Maintain management software database, which has been specifically designed for Divergent Yachting.

A failure to comply with the ISM code might have an impact on the owner’s insurance contracts, as well as the shipowner’s diligence to provide a seaworthy ship.

Mini-ISM Compliance

The management support team at Luxury Yacht Group has been providing custom ISM and ISPS services to yachts since the inception of the codes. Working together with Captains and various regulatory bodies our systems have been refined and proven over the years.

All charter and commercially registered yachts over 500GRT must comply with the International Safety Management Code (ISM) regardless of their flag state. This code is set by the International Maritime Organization (IMO) with established guidelines and systems for the safe operation of yachts with regards to the safety of the passengers, crew and the protection of the environment.

Luxury Yacht Group develops custom safety management solutions for each yacht, accommodating the requirements of the owner and their crew whilst still complying with regulations. In close cooperation with the Captain and the crew the system will be steadily evolving to improve safe working practices and constantly reduce risks in onboard operations.

Luxury Yacht Group is one of the few yachting companies to have been certified to operate their ISM systems onboard commercial SOLAS compliant passenger yachts up to 36 passengers.

LY2 and mini ISM

The large yacht code (LY2) was developed specifically for commercial yachts and is more flexible with compliance to international regulations by taking into consideration the particular characteristics of yachts. The code covers construction, equipment, crew and safety and requires that all charter yachts under 500 GRT must implement a safety management system. This is more commonly referred to as ‘mini ISM’. Private yachts recognize the advantages of this safety system and are voluntarily complying with ISM, as a yacht working with safe working practices has fewer surprises and operates with a more predictable budget.

The International Ship and Port Facility Security Code (ISPS Code) was developed in response to the terrorist attacks of 9/11 and aims to enhance the protection of ships against theft, unauthorized boarding and the security of crew and passengers.

Döhle Yachts’ Maritime Compliance department specialises in providing a highly pragmatic and experienced approach to the application of local, national and international legislative requirements pertaining to the day-to-day operation of superyachts. The department’s aim is a simple one – supporting owners, managers and crew in the delivery of a professional, effective, safe and regulatory-compliant service, which allows for the guests’ and charterers’ uninterrupted enjoyment of the yacht.

We are responsible for developing our safety and security management services and supporting subsequent onboard implementation. We also provide the focus for all regulatory, flag state and classification society liaison. These services can be utilised in conjunction with our Döhle Yachts Technical  team, which ensures the full range of design, build and service consultancy.

Our yacht compliance staff have extensive experience on both large sailing and motor vessels and are adept at translating legislation into plans that actually work on board large yachts. Our auditors and inspectors undergo continuous training and have excellent working relationships with flag state administrations and the major classification societies.

Our highly regarded ISM (International Safety Management) service, which we provide for superyachts consists of two distinct stages: the development of the systems including on board set up and the subsequent ongoing supervisory and support functions once the systems are in place.

The yacht’s Safety Management System (SMS) will be developed in conjunction with the captain and crew, taking into account all relevant international and national legislation and will form part of the overall yacht management system.

We (under our trading name Döhle Private Marine Clients) hold Documents of Compliance (DOC) for the UK (MCA), Cayman Islands, Lloyds Register, Malta and the Marshall Islands and can very quickly obtain a DOC from any flag state when required.

Cyber Risk and our SMS

Döhle Yachts’ Cyber Risk Management Manual has been developed in accordance with the relevant IMO requirements and forms part of our managed yachts’ Safety Management Systems (SMS).

Cyber risks are becoming much more prevalent in the maritime industry. Our Cyber Risk Management Manual has been designed to allow for vessel-specific systems, preferences and existing procedures to be incorporated, whilst fully encompassing the ethos of the cyber risk management cycle:

  • Identify threats
  • Identify vulnerabilities
  • Assess risk exposure
  • Develop protection and detection measures
  • Establish contingency plans
  • Respond to and recover from cyber security incidents

Our wider ISM service covers all aspects required by the ISM Code, inclusive of cyber risk management.

Mini and Voluntary ISM

We provide Mini-ISM services for superyachts as required by the UK’s MCA Large Yacht Code (LYC) for commercial yachts over 24m and under 500GT. Several other flag states have similar requirements.

Our Mini-ISM system is tailor-made for each yacht using our extensive in-house experience.

The system includes the provision of a shore-based emergency contact, available on a 24 hour basis. This guarantees access to a full support resource whenever it is needed, at defined levels and agreed charges.

If required, a media response organisation can further augment the above services.

Mini-ISM services comprise of two distinct facets: the development of the systems, manuals and on board set up and, subsequently, ongoing support functions once the systems are in place.

Our Mini-ISM services cover all aspects required by the Large Yacht Code. We are happy to provide a detailed overview of the specifics of these services on request.

Voluntary ISM

Some captains and owners of private or commercially registered (<500GRT) yachts may opt to implement a full Safety Management System (SMS) without gaining the underlying flag state certification. Our in-house specialists can provide advice on the best options based on the specifics of each yacht.

We can provide a tailor-made system, which will meet the requirements of a full ISM service whilst taking into account each vessel’s individual requirements.

Our Maritime Compliance team is highly proficient in ensuring that the ISPS (International Ship and Port Facility Security) Code is interpreted correctly, and applied, in a realistic manner that actually works on board, via the yacht’s Ship Security Plan (SSP).

Our ISPS service for superyachts consists of two distinct stages: the development of the system to be used on board including an on-site assessment and the subsequent continual supervisory and support functions when the system is in place.

The yacht’s SSP will be developed in conjunction with the captain and crew, taking into account all relevant international and national legislation and will form the basis for security management on board.

Our ISPS services cover all aspects required by the ISPS Code.  We are happy to provide a detailed overview of the specifics of these services on request.

Knowledge – ISPS Code

Designated Person Ashore

To ensure a direct link between the company (Döhle Private Marine Clients) and those on board, the ISM Code requires that a Designated Person Ashore (DPA), with access to the highest levels of management, is appointed.

It is the DPA’s responsibility to monitor the safety and pollution prevention aspects of the operation of each vessel, and to ensure the adequate resources and shore-based support are available.

The DPA also provides the first level of shore-based mediation for any complaints, grievances or disciplinary issues that cannot be resolved on board.

During emergency incidents the DPA is the leader of the Emergency Response Team and provides yacht captains with a single point of contact for any emergency situation which may be encountered.

Döhle Yachts’ Richie Blake, Managing Director, and Matt Gough, Maritime Compliance Manager, are both experienced DPAs and are fully qualified having completed approved Designated Person Ashore training.  They understand the proficiencies necessary for undertaking the role of the Designated Person Ashore under the provisions of the ISM Code.

Emergency and Media Response

We have a purpose-built, dedicated 24/7 Yacht Emergency Response and Crisis Management Room (ERR), which is furnished with all the necessary communications equipment and resources and with ample redundancy to ensure continuity.

The ERR forms the shore-based control centre for any incident be it pollution, safety, security or media related. It serves as the work place for the Emergency Response Team (ERT), which convenes as required to provide the necessary support to owners, crew and managers. The ERT comprises of Döhle Yachts’ staff, augmented, as required, by other experienced ship management staff from the Döhle (IOM) Group. It is the hub for all external support, organisation and communication.

Reporting and ongoing liaison with the authorities is essential. The ERT will coordinate with, for example, the coastguard and rescue services, the owner and/or the owner’s representative, flag state, coastal and port state, hospitals, next of kin, insurance companies and salvors, as well as with all other relevant parties.

In emergency situations, we manage these external pressures allowing the captain and crew to focus solely on the events as they develop on board with the primary aim of maintaining the safety of the passengers and crew in conjunction with the protection of the yacht and the environment.

Our ERT receives in-depth training via regular drills and simulations for the team based on real life situations.

The ERT carry out regular drills and response training with industry leaders. They also have real and relevant experience in managing incidents and the associated media interest.

An incident at sea soon becomes everyone’s business. In an era of instant global communication, the world can soon learn when things go wrong. It is therefore essential that any media interest is correctly managed and other stakeholders are proactively appraised as situations develop.

Any media response regarding a yacht, required as a result of an incident, can be coordinated by trained in-house personnel and supported by industry professionals.

MARPOL and SOPEP Services

All yachts, whether commercial or private, depending on their tonnage, must comply, to varying degrees, with the International Convention for the Prevention of Pollution from Ships (MARPOL, short for Marine Pollution).

All of our response and management plans are provided efficiently, reliably and promptly, and are accepted by flag states as fully compliant documents. Aided by our in-house professional expertise, we are able to provide full support to our clients and continuously maintain our Ship Oil Pollution Emergency Plan (SOPEP) and other response manuals. In the case of other national MARPOL requirements, we are also able to provide the necessary plans.

We will also provide full annual maintenance of your response plans and provide timely updates as a result of ongoing changes to legislation. These will be incorporated to the highest standard, ensuring ongoing compliance.

Under the ISM code, each Commercial Yacht over 500GT is required to have a Safety Management System (SMS) in place. The system demonstrates compliance with regulations that control safety, environmental protection and communication with land-based support.

MINI INTERNATIONAL SAFETY MANAGEMENT (ISM)

A Mini ISM is a Safety Management System (SMS) which is specifically designed for vessels where full International Safety Management (ISM) Code guidelines do not apply (e.g. when a vessel is under 500GT yet over 24 meters).

The Mini ISM is designed to overcome the barriers frequently faced by smaller yachts, giving them equal access to the high standard safety their larger yacht counterparts and full ISM compliance would otherwise bring.

Alexandra Hernández is Riela Yachts’ Yacht Manager. As part of this, Alexandra is the initial point of contact for our vessels; working closely with our other specialists to provide support and service coordination. Alexandra supervises crew management and plays a heavy involvement in the development and maintenance of our award-winning electronic Safety Management System (eSMS).

Born and raised in Colombia, Alexandra completed her degree as a Lawyer, and she is on track to receive her diploma in Superyacht Management.

Alexandra’s legal background and experience within the Marine & Aviation industries cover a wide range of roles, helping to gain invaluable knowledge, develop communication skills and actively cultivate solid industry relationships to deliver the highest of standards in every project.

George Self is a Safety & Compliance Manager and responsible for the implementation and development of operational compliance for yachts at the company.

Accruing a 10-year service of sea time, beginning as a deckhand before respectfully concluding her career as a Chief Officer, George now contributes a wealth of first-hand practice and insight into the support she now provides to yachts daily. George also brings shore side experience from her time working at a number of established Ship Management firms on the Isle of Man.

Ken has spent over 30 years working in the Yachting industry at Boatyards and materials manufacturers, and more recently as a Specialist Business Advisor. During this time Ken has served as International Superyacht Society (ISS) President and is currently on the Superyacht UK Executive Committee. He also works as a project leader on the ISO work group focused on Superyacht Quality.

The experience that he brings to The Riela Group in optimising our internal business processes helps to ensure that the quality of service we provide to our clients is at the highest level.

Mark Bridson is a Product and Development specialist and responsible for the integration of Laserfiche within the company and the developing of an electronic Safety Management System.

Marks career started in the Royal Air Force as a data analyst maintaining Aircraft engineering records and the provision of Aircraft statistics.

Returning to the Island Mark spent the next 25 years working in IT for an aircraft design company. In this role he provided Computer Aided Design and document management support for offices within the UK and Europe.

Moving from the Aircraft industry to Maritime, Mark has spent two years with a Yachting software solutions company using Laserfiche to design purchase ordering systems for Superyachts.

Tina Dahn is a Crew Officer and responsible for the administration of yacht crew contracts, monthly payroll and crew certification at Riela Yachts.

After a 12 year service in the Royal Navy undertaking various administration and PA roles, Tina began working for the NHS in 2001 and was responsible for duties including managing payroll, recruitment and HR administration.

Tina returned to the Isle of Man to undertake the role of Crewing Officer in the superyacht industry in 2011, where she oversaw a portfolio of clients whom she provided crew employment, administration and payroll services.

Christian gained a postgraduate Master in Finance degree at the University of Neuchatel, Switzerland and completed his MBA at the University of Chicago Booth School of Business.

Before joining us, Christian worked for six years at Argosy Capital, an Isle of Man-based private equity and venture capital business focusing on early-stage growth businesses. At Argosy, he focused on managing investment companies, research and financial analysis and served as a director on several boards.

Although full compliance is not required for superyachts 499GT and below, there are standards you need to comply with under the mini ISM regulations. The UK Maritime & Coastguard Agency (MCA) Large Yacht Code requires all commercial vessels under 500GT to maintain a Mini-ISM system. It is strongly recommended that all yachts under 500GT maintain a Mini-ISM wherever possible.

A Mini-ISM is a safety management system based on the ISM Code but tailored specifically to the needs of commercial yachts over 24 meters and under 500GT which otherwise, under international maritime law, have to comply with a full ISM system.

All commercially operated yachts under 500 gross tonnage must design and implement a SMS which adheres to all regulations and standards issued by international bodies such as the International Maritime Organisation (IMO) as well as local governments and private bodies such as classification societies and flag states.

The ISM Code stands for the International Safety Management Code which in turn is short for the International Management Code for the Safe Operation of Ships and for Pollution Prevention as adopted by the International Maritime Organisation (IMO). The ISM Code provides an international standard for the safe management and operation of ships and for pollution prevention.

The Support4yachts ISM and checklists are delivered as a web application as either standard or bespoke documents that allow approved users the ability to control vessel or fleet safety management systems anywhere. This offers a structured, paperless and auditable way to demonstrate due diligence in managing the owner’s valuable asset and safeguarding the lives of those on-board.

The purpose of a Mini-ISM is to:

  • Promote and ensure safety at sea for the yacht's crew and guests and third parties
  • Avoid damage to the yacht
  • Avoid damage to the environment
  • Covers the required aspects fulfilling all LY2/3 requirements, which include but are not limited to:
  • Risk Assessment – To minimise the chance of accidents.
  • Safety and Environmental Protection Policy.

The International Convention for the Prevention of Pollution from Ships (MARPOL, short for Marine Pollution) was adopted in 1973 and entered into force ten years later. All yachts, whether commercial or private, must comply with MARPOL, where applicable.

It contains regulations designed to prevent pollution of the sea, land and air caused accidentally or during routine operations by ships transporting oil cargoes, by noxious or harmful cargoes, and by sewage and garbage. It also aims at cleaning up the oceans. It contains requirements for storing, treating and discharging of the above-mentioned substances as well as procedures for reporting of incidents involving dangerous goods, harmful substances and/or marine pollutants. The convention includes the following six annexes:

The original MARPOL Convention 73 together with the 78 Protocol is collectively known as MARPOL 73/78.

Regulation 37 of Annex I of MARPOL requires that oil tankers of 150 tons gross tonnage or more and all ships of 400 tons gross tonnage or more carry an approved shipboard oil pollution emergency plan (SOPEP). The International Convention on Oil Pollution Preparedness, Response and Co-operation, 1990, also requires such a plan for certain ships.

SOPEP in itself is a guideline for the response of the vessel’s crew in case of oil pollution and how to report, who will be reporting and what should be reported. It also gives a guideline to control discharge action - with consideration based on Navigation Measures and Seamanship Measures.

All superyachts, whether commercial or private, must comply with the International Convention for the Prevention of Pollution from Ships (MARPOL, short for Marine Pollution).

From 1 January 2013, there is now a mandatory requirement for all yachts that are 400GT and over to complete and maintain a Ship Energy Efficiency Management Plan (SEEMP).

In its simplest form, and for the purposes of port state control inspections, a SEEMP is simply a set of documents that demonstrates that the vessel has reviewed and has a plan for improving energy efficiency. For superyachts, the plan might include, for example, sections on engine tuning and monitoring, hull and prop condition, reduction of auxiliary power, reduction of speed, trim and draft, and voyage execution and routing.

International Ship and Port Facility Security Code

Our experience is invaluable in ensuring that ISPS (International Ship and Port Facility Security Code) for yachts is interpreted correctly and applied to the superyacht’s Ship Security Plan (SSP) in a user-friendly and efficient manner that works on board.

Our ISPS service for superyachts consists of two stages:

  • The development of the systems including on board set up
  • The subsequent ongoing supervisory and support functions once the systems are in place.

The yacht’s SSP will be developed in conjunction with the Captain and crew, taking into account all relevant international and national legislation and will form part of the overall ship security system.

Set-up and Services

In addition to our pragmatic and experienced approach to ISPS Code implementation on board large yachts, we provide the following:

  • Review proposed security arrangements and advice as required
  • Ship’s Security Assessment including On Scene Survey
  • Provision of Ship Security Officer Course, ashore and on board
  • Developing yacht specific security Contingency Plans (CPs)
  • Ship’s Security Plan (SSP) preparation, submission and approval from Flag State
  • Implementing the SSP on board and briefing to crew on the system
  • Liaison with Flag State for ISPS Pre-Verification and the award of the Interim International ShipSecurity Certificate (ISSC)

Garbage Management - MARPOL Annex V

On 1st January 2013 MARPOL Annex V requirements for the prevention of pollution by garbage from ships entered into force. The new Annex requires that the discharge of all garbage into the sea is prohibited, except as expressly provided otherwise.

Additionally, Regulation 10.2 of Annex V will require that every vessel of 100 gross tons (GT) and above, and every vessel certified to carry 15 or more persons have a Garbage Management Plan. This lowers the tonnage requirement from its current level of 400 GT, which will have implications for a large number of smaller vessels such as offshore supply vessels (OSV), tugs, and yachts.

On 7 February 2006, the ILO, a United Nations agency, established the Maritime Labour Convention (MLC 2006). According to the convention, all commercial ships over 500 GT trading internationally will require a Maritime Labour Certificate and a Declaration of Maritime Labour Compliance. The convention will also apply to ships below 500 GT or those operating on domestic trades (within the flag’s territorial waters) but will not require certification, only inspection.

The convention is now ratified and shall come into force in August 2013.

Shipowners will be required to develop and carry out the requirements of the convention as ratified within the regulations of the flag state. The purpose of MLC 2006 is two fold; to reduce accidents at sea and to protect the rights of the seafarer. The main features covered by the MLC 2006 are: safe and secure working conditions, fair terms of employment, proper living conditions, medical care, hours of rest, recreational facilities, food and catering and welfare and social protection.

For most shipowners, the convention should not alter normal operational standards and procedures as most procedures are already in compliance and only slight changes may be required to comply with protocol of the convention. Shipowners concerned about compliance and requirements can approach their classification societies who are now making a diligent effort to assist shipowners with the requirements to ensure compliance is done at an early stage. The company’s or yacht’s safety management system (SMS) is at the core of compliance with the new convention. It is likely that the new procedures, policies and records of compliance will need to be incorporated into the SMS, especially as this is required for evidence of on-going compliance.

Upon flag state approval of MLC 2006 compliance, the ship will be issued with a Maritime Labour Certificate & Declaration of Maritime Labour Compliance (DMLC)

The certification will be subject to revalidation every five years, with mid-term assessments of the quality of the compliance onboard. It will also form part of future port state control inspections. The issue of a Maritime Labour Certificate to a ship is evidence that the ship complies with the requirements of the convention and meets the flag state’s approval for seafarers’ living and working conditions onboard.

The DMLC is attached to the Maritime Labour Certificate and is completed by both the flag state and the shipowner.

Shipowners will be held responsible under the convention for certain liabilities incurred by the seafarer, ranging from injuries and compensation, to repatriation. Many of these requirements are already shouldered by shipowners. P&I club cover may include some of the liabilities arising out of the convention, however the owner remains liable for these claims even if they arise from war, terrorism, insolvency or bio chemical attack. In these circumstances club cover is currently either limited or not available. Owners will be required to provide evidence of financial security for these claims. Under the MLC owners will be liable for crew repatriation as a result of business insolvency and claims for unpaid wages. They will also be required to provide financial security for such abandonment claims. There will be a right of direct action against the financial security provider for the cost of repatriation and reasonable expenses incurred by the seafarer from the time of abandonment until the time of repatriation and outstanding wages and other contractual entitlements, limited to a period of four months. Currently there is no P&I club cover for these claims and the clubs will not provide the requisite financial security, as this would be a guarantee for an owner’s financial default.

The Maritime Labour Convention, properly implemented, will provide a comprehensive set of maritime labour rules to protect Seafarer rights to a safe working environment, to healthy conditions and appropriate training.
