Die Rolle des Yachtmaklers

Was sollten Sie als Verkäufer oder als Käufer von einem Yachtmakler erwarten?

Natürlich sind das zwei ganz unterschiedliche Perspektiven und oft vermeintlich gegensätzliche Interessenlagen.

Der Makler erhält in der Regel vom Eigner des Schiffes den Verkaufsauftrag und ist natürlich daran interessiert, seine Provision zu verdienen. Mach ihn dies automatisch zum Vertretern des Verkäufers? Mit der Erteilung des Verkaufsauftrages und dem Abschluss der Maklervereinbarung geht der Makler natürlich zunächst dem Verkäufer gegenüber die Verpflichtung ein, den Verkäufer als dessen Vertreter zu repräsentieren und das Angebot einem möglichst großen Kreis potenzieller Interessenten zugänglich zu machen. Der Makler als Vertreter beider Parteien beim Yachtkauf: Der Verkäufer vereinbart in der Maklervereinbarung auch die Verkaufsprovision. Steht der Makler dem Verkäufer damit näher als dem Käufer? Zunächst einmal schon, insofern als dass der Makler den Verkäufer natürlich erst einmal besser kennt als den Käufer. Aber die Rolle des Makler ist grundsätzlich unparteiisch. Wie kann das sein, wo doch der Verkäufer argumentieren wird dass er die Verkaufsprovision zu bezahlen hat? Dafür könne er schließlich erwarten dass dieser seine Interessen vertritt. Nun, das ist insofern zutreffend als dass der Verkäufer bei Abschluss der Maklervereinbarung das Zugeständnis des Provisionsanspruchs macht. Dennoch ist diese Annahme in der Gesamtbetrachtung unzutreffend, denn letztlich ist die Maklerprovision Teil des Kaufpreises den beim Abschluss letztlich der Käufer akzeptiert und bezahlt. Daher ist das korrekte und zutreffende Ergebnis dieser Betrachtung, dass der Makler letztendlich beiden Parteien gleichermaßen verpflichtet ist. Was kann der Verkäufer von einem Makler erwarten?

Ein guter Yachtmakler berät den Kunden hinsichtlich des zu erwartenden Verkaufswertes der Yacht. Der Verkäufer sollte nicht erwarten, einen deutlich höheren Preis zu erzielen als er dies beim selbstorganisierten Verkauf würde. Aber er darf erwarten dass der Makler die Fachkenntnis hat, einen marktgerechten Preis zu ermitteln und vorzuschlagen. Die wesentliche Aufgabe des Maklers liegt darin, aussagefähiges und ansprechendes Präsentationsmaterial zusammenzustellen und mit möglichst großer Reichweite zu veröffentlichen. Darüber hinaus bietet ein Makler die Yacht gegebenenfalls bestehenden Kunden an die konkret auf der Suche nach einem vergleichbaren Objekt sind.

Der Makler setzt seinen Klienten regelmäßig von der erzielten Reichweite der Verkaufspräsentation in Kenntnis und beantwortet alle Anfragen und hält den Kontakt zu den Interessenten. Dies können, je nach Schiff, regelmäßig zwischen 20 und 50 Anfragen sein bis es zu einer ersten konkreten Besichtigung kommt. Aber das Ziel ist der erkauf und in der Regel werden sich 5 bis 10 interessenten das Schiff ansehen bevor es dann tatsächlich zu einem konkreten Angebot und schließlich zum Abschluss kommt. Bei konkreten Besichtigungsanfragen organisiert der Makler in Abstimmung mit dem Eigner die Terminvereinbarungen, eventuelle Werfttermine zur Besichtigung des Unterwasserschiffes und schlägt dem Verkäufer auf Anfrage geeignete Gutachter vor oder gibt Empfehlungen wie diese zu finden wären (Gutachtervereinigungen, etc.).

Sobald es zum Abschluss kommt, berät der Makler beides Parteien hinsichtlich der erforderlichen Dokumente und Formalitäten und empfiehlt gegebenenfalls rechtliche oder steuerliche Beratung um eine rechtssichere Abwicklung zu gewährleisten.

Was kann der Käufer von einem Makler erwarten?

Der Makler informiert den Kunden über das Schiff nach bestem Wissen und Gewissen. Fragen die nicht aus der vorliegenden Dokumentation des Schiffes zu beantworten sind leitet der Makler zeitnah an den Eigner weiter und bemüht sich, die erwünschten Informationen zeitnah zur Verfügung zu stellen.

Auf keinen Fall sollte ein Makler ihm bekannte Mängel verschweigen. Die ist nicht nur im Interesse des Käufers. Auch der Makler hat ein grundsätzliches Interesse an korrekter Präsentation, denn letztendlich tritt ein Makler regemäßig mit seinem guten Ruf für das zu vermittelnde Geschäft ein. Der Makler berät den Kaufinteressenten sofern dieser ein Angebot abgeben möchte, ob dessen Preisvorstellungen für den Verkäufer realistisch und akzeptabel sein könnten. Sollten sich bei der Besichtigung oder durch ein Gutachten bisher nicht berücksichtigte Mängel ergeben die eine Preisanpassung rechtfertigen, bemüht sich der Makler, zwischen Verkäufer und Kaufinteressent zu vermitteln. Sollten Formerfordernissen beim Vertragsschluss dies verlangen oder sollte eine rechtssichere Ausgestaltung des Kaufvorgangs die Hinzuziehung eines Notars, anwaltliche oder steuerliche Beratung nötig machen, wird der Makler, sobald er davon Kenntnis erlangt, darauf hinweisen und kann gegebenenfalls auch Empfehlungen aussprechen. Kaufvorgang und Deposit:

Üblicherweise wird der Makler in dem Moment wo ein Angebot vom Kaufinteressenten vom Eigner akzeptiert wird, vom Käufer ein Deposit, also eine erstattungsfähige beziehungsweise mit dem Kaufpreis zu verrechnende Anzahlung üblicherweise in Höhe von 10% des Kaufpreises verlangen. Mit Überweisung dieser Anzahlung und der Unterschrift unter den Vorvertrag (oft auch als MOA, Memorandum of Agreement bezeichnet) verpflichtet sich der Verkäufer, die Yacht zum vereinbarten Preis an den Kaufinteressenten zu verkaufen. Damit ist die Yacht für den Kaufinteressenten zunächst reserviert. Nun sind Verkäufer und der künftige Yachteigner in der Pflicht: Der Verkäufer muss im erforderlichen Umfang Zugang zum Schiff gewähren und für die Beibringung der erforderlichen Dokumente kooperieren. Der Kaufinteressent ist im Gegenzug verpflichtet, innerhalb einer zu vereinbarenden angemessenen Frist die Besichtigungen und eventuell Gutachten abzuschließen und seine finale Entscheidung hinsichtlich des Kaufes mitzuteilen. Sollten sich bei Besichtigung oder Gutachten noch nicht berücksichtigte preisrelevante Mängel oder Beanstandungen ergeben, so kann der Kaufinteressent ein Änderungsangebot abgeben oder vom Kauf zurücktreten. Wird ein Änderungsangebot abgegeben, muss der Verkäufer entscheiden ob er dieses akzeptiert. Sobald sich beide Parteien einig sind, kommt es zu eigentlichem Vertragsschluss und Durchführung. Diese kann je nach Land und geltendem Recht Formerfordernissen wie etwa notarieller Beurkundung unterliegen. Im deutschen Recht besteht auch bei eingetragenen Seeschiffen keine Pflicht zur notariellen Beurkundung, allerdings ist der Vertrag bis zur Erfüllung, also Übergabe des Schiffes und Übertragung des Eigentums, z.b. durch Eintragung ins Seeschiffsregister, schwebend unwirksam und wird ohne Notariellen Vertragsschluß erst durch die beidseitige Erfüllung rechtskräftig. Auch die Eintragung in Registern anderer Länder kann die Vorlage einer notariellen Urkunde verlangen. Wenn es zum Abschluss kommt, wird der Makler das hinterlegte Deposit mit dem Verkäufer abzüglich seiner Provision abrechnen. Sollte eine der Parteien vom Vertragsschluss zurücktreten, wird der Makler das Deposit, gegebenenfalls abzüglich mit dem Kaufinteressenten vereinbarten in dessen Namen getätigten Auslagen erstatten.

Hinweis zur Hinterlegung des Deposits: Es wird empfohlen, die Depositzahlung mittels eines Escrowservices, also über ein pfändungssicheres Und-Konto abzuwickeln. Hierbei verhält es sich so, dass der Zahlungsempfänger den Absender der Zahlung zum Zahlungsvorgang über einen vereinbarten Dienstleisters einläd. Nachdem die Zahlung auf dem Anderkonto des Zahlungsdienstleisters eingegangen ist, kann diese nur mit Zustimmung des Zahlungsgebers an den endgültigen Empfänger freigegeben werden. Im Gegenzug bedarf es der Zustimmung des Zahlungsempfängers wenn die hinterlegte Zahlung rückabgewickelt werden soll.

The Maritime Security Act of 1996 (MSA) authorized the establishment of a Maritime Security Fleet under the Maritime Security Program (MSP), which serves as a means for establishing a fleet of commercially viable and military useful vessels to meet national defense as well as other security requirements.

The MSP was originally established in 1996 as a 10-year program for up to 47 vessels in U.S. registry. Reauthorized in 2003, and in 2013 for 10 more years, the number of ships in the fleet was increased from 47 to 60. In 2013, the program was extended to 2025. In 2018 it was extended again.

• The MSP maintains a core fleet of U.S.-flag, privately-owned ships operating in international commerce which are also available under agreement to provide capacity needed to meet Department of Defense (DOD) requirements during war and national emergencies.

• All MSP dry cargo ships are enrolled in the Voluntary Intermodal Sealift Agreement.

• MSP tankers are enrolled in the Voluntary Tanker Agreement.

• Approximately 121,000 20-foot equivalent units (TEU’s), 3.4 million square feet and 666,800 Bbls of tanker capacity are committed to DOD through MSP obligations.

• MSP ship crews are a major source for the DOD surge fleet. The MSP contributes approximately 2,400 mariner positions to the U.S. deepwater seafarer base.

With numerous undeniable benefits and champions at every level of government, it may be hard to imagine why anyone would oppose the Maritime Security Program (MSP). Since the program’s inception more than two decades ago, every U.S. Defense Secretary, U.S. Transportation Command (USTRANSCOM) ranking officer and Maritime Administrator has praised MSP as an essential component of the national defense.

Diamond Packages are the most expensive VIP option on MovieStarPlanet and MovieStarPlanet 2. Colloquially, they have been shortened to "diamond packs" or "dpacks" so players can more easily refer to them.

Diamond Packages offer the most benefits out of all of the VIP options. When buying the year-VIP subscription, players will receive 180,000 coins, 1,440 diamonds, a VIP ticket, and exclusive items that can be traded among players. Diamond Top-Up packs give the player 120,000 coins and 1,000 diamonds. Non-Star-VIP members cannot buy the Diamond Top-Up Package. Diamond Packages come in a male and female variant. Players will receive the same amount of coins and diamonds regardless of the gender they purchase.

The various benefits of the Diamond Packages have changed throughout the years. The amount of coins and diamonds awarded to the player have been a common change. The most recent changes to the year-VIP pack were introduced on October 28th, 2022, where diamonds were increased from 825 to 1,440 and starcoins from 120,000 to 180,000. This change also introduced a new tier of top-up pack (platinum) and made top-up packs accessible to all players.

Obtaining [ ]

The following list are all of the known ways to obtain a Diamond Package.

• Bought as year-VIP.
• Discounted Diamond Packages will reward the user with everything but extended VIP time.
• Gift certificates are not gendered. Although any user can redeem a Diamond Package gift certificate code, the Diamond Package automatically detects the gender of the user's avatar. Female avatars cannot obtain the male items through gift certificates, and vice-versa.

VIP Ticket [ ]

The VIP Ticket is a perk exclusive to the Diamond Package. It was first introduced in 2018 and has been a regular perk of Diamond Packages since.

Players who buy a Diamond Package (discounted or otherwise) are given a non-fungible, one-use item that sits in the "VIP Gifts" tab of the trading system. Tickets can be traded between players like regular items. Once traded, the ticket does not automatically activate. Players must manually activate it themselves.

Activating this ticket will grant the User One Week of regular VIP, and 1,000 coins and 10 diamonds as a reward.

Campaigns [ ]

MovieStarPlanet releases a new Diamond Pack campaign every month. These campaigns are themed, usually after an animal, a season, or a holiday. As of 2021, it has become more common for two or more campaigns to release in one month.

A key feature of Diamond Packages are the exclusive items they offer during campaigns. The items come in a male and female version, and they traditionally feature hair, clothing, and a pet. The items of previous packs are for the most part unattainable , making them highly sought-after. Players can trade these rare items, but they cannot obtain them any other way once the respective campaign has ended. Because of this, rare trading has become a popular activity among many players.

It is possible for previous items to become obtainable again. Some items have lost their exclusivity as they have been placed back into the store for an extended period of time. Notable examples include the fire dress from the Elemental Set and the hat from the 2012 Xmas Set. Similarly, exclusive items may return to the store during Rare Week .

Glitches [ ]

There have been numerous glitches associated with Diamond Packages throughout the history of MovieStarPlanet.

Patched [ ]

• By using a VPN, players were able to buy cheapened Diamond Packages. However, this did not work if you used a Turkey VPN.
• May 2022: Players could obtain the May 2022 items by shopping with another player and buying what they have on.
• If a non-Star-VIP member tries to buy a Diamond Top-Up package, the player receives an error message saying "This Chatroom is for VIP only".

Unpatched [ ]

• Sometimes upon purchasing Diamond Packages on mobile, the game does not register the purchase and does not reward players with the package.
• When buying Diamond Packages on mobile, sometimes players are unable to change the color of their items.
• The lips from the Bubble Gum Set discolor the face of the avatar.
• The hair from the Bat Set has a tiny red dot.

MARAD’s MSP and TSP sealift programs are now fully enrolled

U.S. Transportation Secretary Pete Buttigieg: “In the years ahead, these vessels will deliver vital goods, strengthen both our economy and our national security, and create good jobs for American mariners.”

The U.S. Department of Transportation’s Maritime Administration (MARAD) says that its two key sealift programs, the Maritime Security Program (MSP) and the new Tanker Security Program (TSP) are now fully enrolled.

The MSP and TSP sealift programs provide U.S.-flagged and U.S.-crewed ships for U.S. Department of Defense (DoD) sustainment sealift requirements during times of conflict or in other national emergencies and both pay shipowners a retainer for each enrolled vessel.

“In peacetime, our U.S.-flagged commercial fleet serves as a critical link in our supply chain; and in times of war and crisis, it supports military missions around the globe,” said U.S. Transportation Secretary Pete Buttigieg. “In the years ahead, these vessels will deliver vital goods, strengthen both our economy and our national security, and create good jobs for American mariners.”

The newly selected MSP vessels, Liberty Power and Tulane , are operated by Liberty Global Logistics, LLC of Lake Success, N.Y. and Fidelio Limited Partnership of Ponte Vedra Beach, Fla., respectively. The U.S.-flagged Liberty Power is a twelve-year-old roll-on roll-off vessel (RO/RO), with 220,586 square feet of militarily useful cargo capacity. The Tulane , which was previously operated by Wallenius Wilhelsen , is an eleven-year-old RO/RO vessel with 194,665 square feet of militarily useful cargo capacity. It is scheduled to reflag under U.S. registry by the end of this year and will be renamed the Arc Honor.

The final product tanker selected for TSP is the Pyxis Epsilon operated by U.S. Marine Management, LLC of Norfolk, Va. The eight-year-old, 325,000 barrel tanker is scheduled to reflag under U.S. registry by the end of this year and will be renamed the Shenandoah Trader . Back in September, Maroussi, Greece, based Pyxis Tankers Inc. reported that it had agreed to sell the ship “for a sale price of $40.75 million in cash to an unaffiliated buyer located in the United States.”

“MSP and TSP accomplish two key maritime sealift objectives: both grow our U.S.-flagged commercial fleet to benefit the U.S. economy, and both sustain our ability to deliver vital supplies to support military missions across the globe,” said Maritime Administrator Ann Phillips. “MSP has been a success story for the U.S. maritime industry for over 27 years. MSP, together with its sister program TSP, will support U.S. economic competitiveness globally, and ensure U.S. armed forces have unquestioned logistics access anywhere in the world. The award of these three final Operating Agreements will ensure the programs’ continued success and value to the United States.”

The MSP was established in 1996, and now supports a fleet of 60 commercial ships operating internationally. The recently established TSP supports a fleet of 10 commercial product tankers operating internationally and capable of loading, transporting, and storing on-station bulk petroleum refined products to support national economic security and DoD contingency requirements.

“These vessels are pivotal in enhancing global readiness and safeguarding our nation’s supply chains. Both MSP and TSP underscore our steadfast commitment to national security and economic stability and exemplifies the indispensable partnership between MARAD and USTRANSCOM,” said Commander of U.S. Transportation Command, Gen. Jacqueline Van Ovost.

MARAD notes that both programs help address the shortage of both U.S.-flag ships and U.S. Coast Guard-credentialed mariners with unlimited licenses.

MARAD Announces Full Enrollment in Maritime and Tanker Security Programs

The U.S. Department of Transportation’s Maritime Administration (MARAD) has announced its Maritime Security Program (MSP) and Tanker Security Program (TSP) have reached full enrollment with the addition of three new ships. The programs provide the Department of Defense (DOD) with access to a fleet of U.S.-flagged sustainment sealift vessels and product tankers during times of armed conflict or national emergency.

U.S. Transportation Secretary Pete Buttigieg highlighted the importance of the U.S.-flagged commercial fleet, which serves as a critical link in the supply chain during peacetime and supports military missions globally in times of war and crisis. “In the years ahead, these vessels will deliver vital goods, strengthen both our economy and our national security, and create good jobs for American mariners,” said Buttigieg.

Under the MSP, two newly selected vessels, Liberty Power and Tulane , operated by Liberty Global Logistics and Fidelio Limited Partnership, respectively, have been enrolled. Liberty Power is a 12-year-old roll-on roll-off vessel (RO-RO) with cargo capacity of 220,586 square feet, while Tulane is an 11-year-old RO-RO vessel with 194,665 square feet of cargo capacity. Tulane is scheduled to reflag under U.S. registry by the end of the year and will be renamed the Arc Honor .

In addition, the Pypxis Epsilon , an 8-year-old, 325,000-barrel tanker operated by U.S. Marine Management, has been selected for the newly established Tanker Security Program. The tanker is expected to reflag under U.S. registry by the end of the year and will be renamed the Shenandoah Trader.

The Tanker Security Program consists of 10 active, commercially viable, privately-owned U.S.-flag product tankers that are available to meet national defense and other Department of Defense requirements. The enrollment of the first nine tankers in the TSP was announced by MARAD in July. The nine tankers consist of three vessels each from Overseas Shipholding Group (OSG), Crowley-Stena Marine Solutions, and Seabulk Tankers.

Maritime Administrator Ann Phillips emphasized that both the MSP and TSP programs achieve two essential maritime sealift objectives: growing the U.S.-flagged commercial fleet to benefit the economy and ensuring the delivery of vital supplies to support military missions worldwide.

The MSP, established in 1996, aims to strengthen the U.S. supply chain by maintaining a viable presence for the U.S.-flag Merchant Marine in international trade while creating job opportunities. The program currently supports a fleet of 60 commercial ships operating internationally.

“MSP has been a success story for the U.S. maritime industry for over 27 years,” said Phillips. “MSP, together with its sister program TSP, will support U.S. economic competitiveness globally, and ensure U.S. armed forces have unquestioned logistics access anywhere in the world. The award of these three final Operating Agreements will ensure both the programs’ continued success and value to the United States.”

Gen. Jacqueline Van Ovost, Commander of U.S. Transportation Command, said these vessels play a crucial role in improving global readiness and protecting the nation’s supply chains.

“Both MSP and TSP underscore our steadfast commitment to national security and economic stability and exemplifies the indispensable partnership between MARAD and USTRANSCOM… Both programs help address the shortage of both U.S.-flag ships and U.S. Coast Guard-credentialed Mariners with unlimited licenses,” said Van Ovost.

The full enrollment of the TSP comes as the Department of Defense has started to defuel its largest bulk storage facility, the  Red Hill Bulk Fuel Storage Facility  (RHBFSF), located at Joint Base Pearl Harbor-Hickam in Honolulu, Hawaii. The defueling and eventual closure of the WWII-era facility comes after a 2021 leak contaminated drinking water.
